<br /> <br />to the agenda, once filed, without a two-thirds recorded vote of all <br />members to which the Agency is entitled; provided that no item <br />shall be added to the agenda in the manner provided herein, if it is <br />of reasonably major importance and action thereon by the Agency <br />will affect a significant number of persons. <br /> <br />(c) The Agency shall maintain a list of names and addresses of <br />persons who request notification of meetings and shall mail a copy <br />of the notice to such persons at their last recorded address no later <br />than the time the agenda is filed under subsection (b). <br /> <br />(5) Special Meetings. Special meetings of the Agency for the transaction of its <br />business may be held at any time and place as scheduled by the Agency <br />and authorized by law. <br /> <br />(6) Emergency Meetings. If the Agency finds that an imminent peril to the <br />public health, safety or welfare requires a meeting in less time than is <br />provided for in Rule 1.5c(4), the Agency may hold an emergency meeting, <br />provided: <br /> <br />(a) the Agency states in writing the reasons for its findings; <br /> <br />(b) two-thirds of all members to which the Agency is entitled agree <br />that an emergency exists; <br /> <br />(c) an emergency agenda and the findings are filed with the Office of <br />the County Clerk and in the Agency’s office; and <br /> <br />(d) persons requesting notification pursuant to Rule 1.5c(4) are <br />contacted by mail or telephone as soon as practicable; and <br /> <br />(e) meets requirements of Section 13-20(c), Hawaiʻi County Code. <br /> <br />(7) Construction. The provisions requiring open meetings shall be liberally <br />construed and the provisions providing for exceptions to open meeting <br />requirements shall be strictly construed against closed meetings. <br /> <br />(8) Public Testimony. In order to provide for equal opportunity to individuals <br />who wish to provide oral testimony to the Agency, the chairperson may <br />limit the time allotted for oral testimony for each individual or on any <br />particular issue. Individuals providing oral testimony are limited to only <br />one three (3)-minute allotment per each agenda item unless otherwise <br />specified by the chairperson. If an individual wishes to assign their <br />allotted time to someone else, then that individual must personally <br />announce this intention to the Agency and if granted by the chairperson, <br /> <br />
