rehabilitated prior to or in conjunction with a <br />rehabilitation Loan, are not expended on repairs. <br />4.0 APPLICANT ELIGIBILITY <br />4.1 CONFLICT OF INTEREST <br />a. To avoid conflict of interest, members of the governing <br />body and the OHCD staff are ineligible from <br />participating in the RRP. <br />b. A State, County or Federal employee would be eligible <br />for the RRP or contract for construction service <br />rendered if the employee is not serving in a capacity <br />which would influence the OHCD's decisions or who <br />formulates policy with respect to the RRP. <br />4.2 DISCRIMINATION PROHIBITED <br />a. Pursuant to the Fair Housing Act of 1988, no person in <br />the United States of America shall on the ground of <br />race, color, national origin, religion, familial <br />status, sex, or disability be excluded from <br />participation in or be denied the benefits of or be <br />subjected to discrimination under any housing program <br />or activity and pursuant to Chapter 515 of the Hawai`i <br />Revised Statutes, no person in the State of Hawai`i <br />shall on the ground of race, sex, color, religion, <br />marital status, familial status, ancestry, disability, <br />age, or HIV (human immunodeficiency virus) infection be <br />excluded from participation or be denied the benefits <br />of, or be subjected to discrimination under any real <br />property program or activity. <br />4.3 INCOME ELIGIBILITY <br />a. Owner borrower shall be income eligible from the time <br />of application for a rehabilitation loan through <br />execution of loan documents. After execution of loan <br />documents, the future income of the owner will not have <br />any affect on the status of their rehabilitation loan. <br />b. Adjusted Gross Annual Income: The occupant’s adjusted <br />gross annual household income is considered in <br />determining eligibility. Current income status will be <br />verified through pay stubs and third-party <br />verification.
