6.3 CONSTRUCTION CONTRACT <br />a. Homeowner and Contractor Agreement: The construction <br />contract is a formal agreement between the homeowner <br />and the contractor to provide the repair services for <br />an agreed price. The County of Hawai`i is not a party <br />to the construction contract; however, the County, in <br />its role as lender, has the right to deny or withhold <br />progress payments when contractual provisions are not <br />followed. <br />b. Contract Provisions: The construction contract shall <br />include, but will not be limited to, the following: <br />1. Contract date; <br />2. Homeowner's name; <br /> 3. Contractor's name; <br />4. Contract amount; <br />5. Number of calendar days to complete the work; <br />6. Payment schedule; and <br />7. Itemized list of repairs. <br />6.4 SECTION 3 COMPLIANCE <br />a. The contractor is subject to the requirements of <br />Section 3 of the Housing and Urban Development Act of <br />1968, as amended, to provide training, employment and <br />business opportunities as set forth in 24 CFR, <br />Part 135. <br />6.5 NOTICE TO PROCEED <br />a. The contractor shall not begin any work until issued <br />the written "Notice to Proceed" authorization by the <br />homeowner and the OHCD. This proceed order may be <br />issued when both the contractor and the homeowner have <br />completed certain obligations specified in the <br />construction contract. <br />b. Contractor Requirements: Prior to being issued the <br />Notice to Proceed, the contractor shall: <br />1. Provide copies of applicable building, planning, <br />plumbing and electrical permits required to <br />7019RBLA -24- RRP RULES/07-07-2016 <br /> <br />
