Do have any other questions for our Counsel? <br /> So I guess my first question to the Board would be if you folks feel <br /> that there is sufficient record at this point in time for us to make a <br /> decision without hearing anybody because that was what you had <br /> mentioned that's an option so I just want to make sure that we're <br /> all clear you know. <br /> Mr. Murai: That's correct. <br /> Mr. Adams: My view is we need to give them the chance to have their say...we <br /> have a member on the Board that's not actually been part of the <br /> prior discussions as well. So I think my view is that we should go <br /> forward. <br /> Ms. Kahakalau: I think we're in agreement to that, but I just wanted to make sure <br /> that we're following the procedures and not leaving out a step for <br /> some reason. <br /> Mr. Murai: Well...Madame Chair. I'd also like to note that I've been in <br /> receipt of correspondence that was recently submitted by the <br /> respondent's Counsel and by Mr. Hyland. One thing I wanted to <br /> point out was that I think as recently as this morning...before I left <br /> my office...I've been seeing email correspondence from Mr. <br /> Hyland that I don't believe Mr. Kenoi's Counsel had been copied <br /> with so I do...if the Board is gonna...I'm not sure even the Board <br /> members have seen it and if they haven't seen it and the Board is <br /> not going to consider it then that's fine. If the Board has seen it <br /> then we'll consider it then I'd suggest that it be provided to <br /> Counsel as well. <br /> Ms. Kahakalau: I didn't see anything and I think we need to you know given how <br /> long this meeting was scheduled...I think people need to adhere to <br /> the timeline of submitting testimonies or statements in a timely <br /> manner...so unless somebody has an objection then we're not <br /> going to entertain that latest correspondence because I certainly <br /> didn't see it.
