expansive here in our acceptance of the information we're <br /> receiving. <br /> Mr. Murai: That's fine,but you know one more thing I'd like to query or raise <br /> with the Board at this point is...before we begin the informal <br /> hearing I do want to note that and I'm not sure whether the Board <br /> members have received this on Monday is was copied with a <br /> memorandum filed by Mr. Eddins on behalf of the Mayor and it <br /> would generally speaking was a memorandum in opposition to the <br /> petition and it as I could discern it asked for two things that either <br /> the petition be dismissed or if the petition is not dismissed that it <br /> be set for a formal hearing. I also wanted to note that in Mr. <br /> Hyland's October 28 memorandum which I believe is going to be <br /> read. I believe it was in that memorandum that he also is asking <br /> for a formal hearing as well. Now I do want to note that this <br /> matter has been calendared for some time as an informal hearing <br /> and that these submissions come very late. However, I do suggest <br /> that the Board at some point address those requests. <br /> Mr. Adams: So Madame Chair if I may. According to our procedures...we <br /> have to go through the process of an infoinial hearing before we <br /> can get to a fotival hearing. So understanding I've seen both of <br /> those requests, the informal hearing is held before we actually <br /> consider a fon-nal hearing and actually our idea of being able to <br /> consider a formal hearing is based on whether or not after the <br /> informal hearing opinion has been provided that the individual that <br /> is receiving that opinion actually has not met it...and so those two <br /> steps have to occur before we can say we're going to move <br /> forward with a foinial hearing. <br /> Mr. Murai: That's what I meant by addressing those requests. <br /> Ms. Kahakalau: Do we need to make a motion in regards to that or...I'm in <br /> agreement as well. <br /> Mr. Adams: I was going to make that comment when we got to the point of <br /> having the discussion, but we can...that's just part of the <br /> procedures...I don't know if there's a motion that's necessary as a <br /> part of that. <br /> Mr. Murai: I'm not sure...I don't a motion is necessary it's more...we're <br /> already in the hearing and.... <br /> Mr. Goodenow: Right. My understanding is there already has been a motion and <br /> that's what we're here for today to have the informal hearing. <br /> 13 <br />
