We're just <br /> curious...is the Mayor gonna appear as well? <br /> Mr. Sing: He was not planning on appearing today. No. <br /> Mr. Robinson: Okay...because the initial letter that was sent talked about the <br /> appearance of the respondent. <br /> Mr. Sing: I think again the problem is we want to make sure exactly what <br /> this hearing was. Your rules don't require his presence. Nobody <br /> has specifically recently come to us and said the Mayor needs to be <br /> here. It's hard when we can't exactly tell what this petition is <br /> being predicated upon because the evidence we're received is just <br /> some newspaper articles. So I'm not sure the commission was <br /> contemplating quizzing him without any sort of notice about what <br /> conduct so no he's not going to appear here today. <br /> Mr. Robinson: Okay. Thank you. <br /> Ms. Kahakalau: Okay so we requested that all parties attend this meeting in a <br /> formal letter to you and to the Mayor and also to Mr. Hyland and it <br /> had...under unfinished business agendized as a petition which <br /> means you know that this is the time that we ask both the petitioner <br /> and the respondent questions. That's what an informal hearing <br /> does and that's usually what we do so we were you know under the <br /> assumption especially since there was no question from either one <br /> whether they should be there or not be there or need clarification <br /> that it was clear that when you get a request from the Board that all <br /> parties are present that means that we would like all parties to be <br /> present. So that's kind of where we are coming from. <br /> Mr. Sing: And I understand and we don't mean any disrespect, but Mr. <br /> Hyland in August sent you a letter saying he's not going to <br /> 23 <br />
