RULE 3. PROCEEDINGS BEFORE THE AGENCY <br />3.1 General. <br />The Agency may, on its own motion or upon the petition of any interested person or <br />agency of the Federal, State or County government, hold such proceedings as it may <br />deem necessary in the performance of its duties or the formulation of its rules and <br />regulations. Procedures to be followed by the Agency shall, unless specifically prescribed <br />in these Rules or by the Hawaii Administrative Procedure Act (Chapter 91, HRS) or by <br />any other statute, be such as in the opinion of the Agency will best serve the purpose of <br />such proceeding. <br />3.2 Appearances and Practices Before the Agency <br />a. Representation. In any proceeding under these rules, any party may be <br />represented by counsel or any other person to whom he has given written or <br />verbal authority. <br />b. Validation of Authority. When an individual acting in a representative capacity <br />appears in person or signs a paper in practice before the Agency, their personal <br />appearance or signature shall constitute a representation to the Agency that, under <br />the provisions of these rules and the law, they are authorized and qualified to <br />represent the particular person on whose behalf they act. The Agency may at any <br />time require any person transacting business with the Agency in a representative <br />capacity to show his authority and qualification to act in such capacity. <br />c. Bar to Appearance <br />(1) Former Agency Association. No individual who has been associated with <br />the Agency as a member, officer, employee or counsel shall be permitted <br />to appear before the Agency in behalf of or to represent in any manner any <br />party in connection with any proceeding or matter that such individual has <br />handled or passed upon while associated in any capacity with the Agency. <br />(2) Limitations of Assistance from Barred Persons. No person or agency <br />appearing before the Agency in any proceeding or matter shall, in relation <br />thereto, knowingly accept assistance from and compensate any individual <br />who would be barred by Rule 3.2(c). <br />(3) <br />Written Consent to Appear. No person who has been associated with the <br />Agency as a mem.ber, officer, employee or counsel thereof shall be <br />permitted to appear before the Agency in behalf of, or to represent in any <br />manner, any person or agency in connection with any proceeding or matter <br />that was pending before the Agency at the time of his association, unless <br />he shall first have obtained the written consent of the Agency, upon a <br />verified showing that he did not give personal consideration to the matter <br />12 <br />
