Hualālai Road is an unsafe road, it’s substandard, does not meet one single guideline for safety <br />standards, Federal or County. You’ve got telephone poles that are six inches off the road, no <br />curbs, no gutters, no sidewalks. People jogging, riding bikes, skateboards, you name it. And so, <br />that’s why I think that we ought to, you ought to be able to deny a P.U.D. because of safety <br />issues. Why let it continue and go on and on and on. <br /> <br />The other problem is the 14.9-acre development for a P.U.D. We have a perfect example of Lots <br />40 through 43 on Hualālai Road. It was 59 acres; they divided into four 14.9-acre parcels so they <br />could make it a P.U.D. Obviously, it’s not a 14.9-acre development; it’s a 60-acre development. <br />One was approved six or seven years ago, and since they said there’s no coordination between <br />them, why hasn’t that one – that’s Parcel Number 42 – why hasn’t that one ever started one stick <br />of construction, since they’re not coordinated? They obviously are coordinated, and they only <br />divided the 60 acres up into four parcels to circumvent the law. <br /> <br />Thank you very much. <br /> <br />UNGER: Thank you. Are there any other members of the public here to testify? We’re going to <br />go ahead, I will be asking for a motion to close public hearing portion of this hearing so what <br />we’re, and after we close public hearing, we’re going to break for lunch, we’re going to take <br />about a half an hour break. And the discussion right now, subject to us all agreeing, is when we <br />come back, you heard that the Planning Department, because it is difficult to get Leeward and <br />Windward together, we are going to try to formulate a motion that encompasses everything that <br />we can agree on. If we can’t agree on it, we won’t be coming up with a motion; but if we can, <br />we would like to accommodate the Planning Department and try to come up with a motion that <br />we can all agree on. <br /> <br />So, the process will be we may go Chapter by Chapter 1 through 16. We’ll all have a discussion <br />to, we’ll all have an opportunity to discuss Chapter 1 through 16. And what I’ll be proposing to <br />the Planning Department, because most of you are here in regards to Chapter 4, we’ll start at <br />Chapter 4 and at least if you, and to encourage you to stay, stay for the half an hour, if you can, <br />we’ll, we’ll discuss Chapter 4 first, and after the conclusion, we’ll go back to 1 through 16. <br /> <br />I would like a motion to adjourn for lunch. <br /> <br />NOBRIGA: I make the motion. <br /> <br />SHIMAOKA: I second. <br /> <br />UNGER: We have a motion by Commissioner Nobriga, second by Commissioner Shimaoka. <br />All in favor? <br /> <br />COMMISSIONERS: Aye. <br /> <br />UNGER: All opposed? \[None.\] Meeting is adjourned. <br /> <br />26 <br />EXHIBIT A <br /> <br />
