• <br />• <br />FIFTY THOUSAND DOLLARS ($50;00.00). In case alternate bids are required, the <br />amount of the surety bond, cash, cashiers check or certified check shall be <br />based on 'the highest alternate bid submitted. <br />The successful bidder's check or Bid Bond will be retained until he has <br />entered into a satisfactory contract and has furnished the required contract <br />Performance Bond. Failure to furnish a satisfactory Contract Performance Bond <br />within the specified time may be determined to be abandonment of the contract <br />by the bidder and forfeiture of the Certified Check or Bid Bond as Liquidated <br />Damages to the County. The County further reserves the right to hold the <br />Certified Checks or Bid. Bond of the three lowest bidders, until the successful <br />bidder has entered into a contract and has furnished the required Performance <br />Bond. <br />2. DFI%VER,OF PROPOSALS - The entire proposal shall be placed together with <br />the proposal guaranty, in a sealed envelope not smaller than 4-3/4" x 11"t, so <br />marked as to indicate the identity of the project, the project number, the date <br />of the bid opening and the name and address of the bidder and then delivered <br />as indicated in the Notice to Contractors. Proposals will be received up to <br />the time fixed in the public notice for the opening of bids and must by that <br />time be in the hands of the officials indicated. <br />.10 WITHDRAWAL OF PiaDPOSALS - Any bid may be withdrawn at any time prior to, <br />but not after, the time fixed in the public notice for the opening of bids, <br />provided that a request in writing, executed by the bidder or his duly authorized <br />representative, for the withdrawal of such bid is filed with the Engineer. The <br />withdrawal of a bid shall not prejudice the right of a bidder to file a new bid. <br />Whether or not bids are opened exactly at the time fixed in the public notice <br />for opening bids, a bid will not be received after that time, nor may any bid <br />be withdrawn after the time fixed in the public notice for the opening of bids, <br />unless contract award is delayed for a period of over sixty (60) days. <br />2.1,x_ PCU LIC OPENING OF PROFOSALO, - Proposals will be opened and read publicly <br />at the time and place indicated in the Notice to Contractors. Bidders or their <br />authorized agents are invited to be present. <br />24.2 • DEPOSIT AND REFUND FOR PLANS AND SPECIFICATIONS - All, plans and specifi- <br />cations may be obtained from the office of the Chief Engineer, County Building, <br />25 Aupuni Street, Hilo, Hawaii 96720 upon a deposit of the specified amount as <br />stipulated in the Notice to Contractors. Minimum deposit shall be $25.00. <br />The deposit shall be refunded upon the return of the complete plans and <br />specifications, provided that they are returned within thirty (30) consecutive <br />calendar days after the date designated for the opening of bids. No refund <br />shall be made after the expiration of this period. The plans and specifications <br />are the property of the County of Hawaii on loan to the bidder until bids are <br />due. Bidders, should they decide not to submit bid, are requested to return <br />the plans and specifications when such decision is made. The deposit shall not <br />be construed to be the purchase price of any part of these documents. <br />Section 2 <br />Page 9 <br />
