• <br />(1) <br />Contractors Licenses (Section 444) - No person within the purview <br />of this law shall act, or assume to act, or advertise, as general <br />engineering contractor, general building contractor or specialty <br />contractor without a license previously obtained under and in <br />compliance with the provisions of this law and the rules and <br />regulations of the Contractors' . License ..Board .and. Ordinances of <br />the County of Hawaii. <br />7.2 PATENTED DEVICES MATERIALS AND PROCESSES - If the Contractor is required <br />or desires to use any design, device, material or process covered by letters, <br />patent or copyright, the right for such use shall be procured by the Contractor <br />from the patentee or owner. The Contractor and surety shall indemnify and save <br />harmless the State and County from any and all use of any such patented design, <br />device, material or process, or any trademark or copyright in connection with <br />the work to be performed under the contract and shall indemnify the State and <br />County for any costs, expenses and damages which it may be obliged to pay by <br />reason of any such infringement at any time during the prosecution or after <br />the completion of the work. <br />7.3 PERMITS AND I.SCE� - The Contractor shall procure- all permits and <br />licenses, pay all charges and fees and give all notices necessary and incident <br />to the due and lawful prosecution of the work. <br />7.4 SANITARY PROVISIONS -- Unless so waived in writing by the Engineer, the <br />Contractor shall install toilet facilities conveniently located at the jobsite <br />and maintain same in a neat and sanitary condition: "for the use of the employees <br />411/ on the jobsite for the duration of the contract. The toilet facilities shall <br />conform to the requirements of the State Department of Health. The cost of <br />installing, maintaining and removing the toilet facilities shall be considered <br />incidental to and paid for under various contract pay items for work or under <br />the lump sum bids as the case may be, and no additional compensation will be <br />made therefor. These requirements shall not modify or abrogate in any way the <br />requirements cr regulations of the State Department of Health. <br />.5 BARRICADES. DANGER. WARNING AND DETOUR SIGNS - The Contractor shall provides <br />erect and maintain as directed by the Engineer, all necessary barricades, suitable <br />and sufficient red lights, danger signals and signs, provide a sufficient number <br />of watchmen and take all necessary precautions for the protection of the work <br />and the safety of the public. Work areas closed shall be protected by effective <br />barricades on which shall be placed acceptable warning signs. All barricades <br />and obstructions shall be illuminated at night and all lights for this purpose <br />shall be kept burning from sunset to sunrise. Except as otherwise provided in <br />the specifications, full compensation for conforming to the requirements of this <br />section shall be considered as included in the prices paid for the various <br />contract items of work or lump sum bid and no additional compensation will be <br />allowed therefor. The rule and regulations of the State Highway Safety Act <br />shall be complied with. <br />• <br />7.6 PRESERVATION AND RESTORATION DF PROPERTY TREES. MONUMENTS ETC. - The <br />Contractor shall be responsible for the preservation of all public and private <br />property, trees, monuments, etc., along the adjacent to the project; shall <br />use every precaution'necessary to prevent damage or injury thereto; shall use <br />suitable precaution necessary to prevent damages to pipes, conduits and other <br />Section 7 <br />Page 33 <br />
