• <br />• <br />8.7CHARACTER OF WORKMEN OR EQUIPIENT - The Contractor shall at all tines <br />provide adequate supervision and sufficient labor and equipment for prosecuting <br />the several classes of work to full completion in the manner and within the <br />time required by the contract. <br />(a) Character andProficienc,E of Workmen - All workmen must have <br />sufficient skill and experience to perform properly the work <br />assigned to'them. All workmen engaged on special work or <br />skilled work such as bituminous courses or mixtures, concrete <br />pavement or structures, electrical installation, plumbing <br />installation, or in any trade shall have sufficient experience <br />in such work to properly and satisfactorily perform it and <br />operate the equipment involved, and shall make due and proper <br />effort to execute the work in the manner prescribed in these <br />specifications; otherwise, the Engineer may take action as <br />prescribed hereinws <br />Any foreman or workman employed on the project by the <br />Contractor or by any subcontractor who, in the opinion of <br />the Engineer or his authorized representative, is not <br />careful and competent, does not perform his work in a <br />proper and skillful manner or is disrespectful, intemperate, <br />disorderly or neglects or refuses to comply with directions <br />given, or is otherwise objectionable shall, at the written <br />request of the Engineer, be removed forthwith by the Contractor <br />or subcontractor employing such foreman or workman and shall <br />not be employed again in any portion of the work without the <br />written consent of the Engineer. Should the Contractor or <br />subcontractor continue to employ, or again employ such person <br />or persons on the project, the Engineer will withhold all estimates <br />which are or may become due, or the Engineer will suspend the work <br />until such orders are complied with. <br />(b) Insufficieent. WoWo n - In the event that the Engineer, in his <br />judgment, finds the condition whereby insufficient workmen are <br />present to accomplish the work and no corrective action is <br />taken by the Contractor after being informed, the Engineer <br />reserves the right to terminate the contract as provided for <br />under Subsection 8.12 "TERMINATION OF C0NTRACT". <br />(c) E ui ment R uirements - All equipment furnished by the <br />Contractor and used on the work shall be of such size and <br />of such mechanical condition that the work can be prosecuted <br />in an acceptable manner at a satisfactory rate of progress <br />and the quality of work is satisfactory. All equipment, <br />tools, and machinery used for handling materials and <br />executing any part of the work shall be subject to the <br />approval of the Engineer and shall be maintained in a <br />satisfactory working condition. <br />Section 8 <br />Page 40 <br />
