• <br />• <br />• <br />Equipment used on any portion of the work shall be <br />such that no injury to the work, adjacent property or <br />other objects will result from its use. In the event <br />that the Engineer, in his judgment, finds that the <br />equipment is unsatisfactory to prosecute the work <br />in the manner as provided above, he will, order that they <br />be removed and replaced with adequate equipment. If the <br />Contractor fails to provide adequate equipment for the <br />work, the contract may be terminated as provided for <br />under Subsection 8.12 .1EEMIlISATIOM OF CONTRACT'. <br />In the event that the Contractor is paid for furnishing <br />and operating equipment on a force -account basis, it <br />shall be operated as directed by the Engineer in order to <br />obtain maximum production under the prevailing conditions. <br />8.8 CONTRACT TIME - The total contract time allowed for the performance of <br />the work shall be the number of working daysshown in the contract as awarded, <br />plus any additional working days authorized in writing as provided hereinafter: <br />(a) <br />For delays caused by or suspension due to unsuitable weather. <br />conditions or adverse conditions resulting therefrom, the <br />Contractor shall be granted one working day extension for <br />each working day delay due to such causes. <br />A working day shall, be as defined in Subection-1.2 <br />"DEFINITIONS". <br />(b) For increase or decrease in the scope of work caused by <br />alterations, additional or decreased work made raider <br />Subsection 4.2 ''CHANGES", the Contractor shall be granted <br />working day extension or deduction in proportion to the <br />original number of working days allowed as to the cost of <br />the additional or reduced work bears to the original <br />contract amount. However, should the Contractor feel that <br />the contract time as determined above is not a reasonable <br />figure based on the effect it will have on his normal <br />operation had this change not been requested, the Contractor <br />must so .indicate in writing when he submits his detailed <br />cost breakdown as required by Subsection 4.2 ''CHANGES". <br />The Contractor must state how his normal operation will <br />be affected including statements from his subcontractors, <br />suppliers and/or manufacturers as to the extent of the <br />delay. <br />Contract time extension will not be granted for changes <br />which the Engineer determines unjustifiable due to lack of <br />supporting evidence or the change is of such nature that the <br />final completion date will not be affected. In any case; <br />for all time extensions or reductions, the Engineer shall <br />ascertain the facts and extent of the time involved and <br />Section 8 <br />Page 41 <br />
