(e) <br />days to be charged shall be computed by multiplying <br />the number of working days of original contract <br />time by the ratio of the amount earned during the period <br />of partial suspension to the original contract amount. <br />In no case shall the number of working days to be <br />charged as contract time for a period of partial <br />suspension exceed the total elapsed time in working <br />days of the partial suspension. <br />The Engineer will prepare for each estimate made under the <br />provisions of Subsection 9.6 ='PARTIAL PAYMENTS" a statement <br />of the working days charged during the period, the number <br />of working days in the contract, the working days' <br />extensions granted for reasons stated herein and the <br />number of working days remaining to complete under the <br />contract. <br />Copies of such statement will be promptly submitted to the <br />Contractor for his approval and signature. The Contractor <br />shall signify his approval of the statement by signing <br />same or submit his objections within five (5).days setting <br />forth in what respect the statement is incorrect. Failure <br />of the Contractor to submit his objections within the <br />specified time shall mean that the Contractor has <br />accepted the Engineer's statement as being correct. <br />No consideration will be made for extension of contract <br />time due to delays to the contract caused by the failure <br />of the Contractor to submit for approval by the Engineer <br />shop drawings, descriptive sheets, material samples, <br />color samples, etc. except as covered in Subsection 8.8(c). <br />8. SUSPEI�3SION OFWim= — The Engineer may, by written order, suspend the <br />performance of the work, either in whole or in part for such periods as he may <br />deem necessary due to: <br />(a) Weather or soil conditions considered unsuitable for <br />prosecution of the work, or <br />(b) Failure on the part of the Contractor to: <br />(c) <br />• <br />1. Correct conditions unsafe for the general public or for <br />the workmen <br />2. Carry out orders given by the Engineer, or <br />3. Perform any provisions of the contract <br />Unforseen soil conditions where a redesign of foundation is <br />necessary or when any other redesign for any reason deemed <br />necessary by the Engineer. <br />Section 8 <br />Page 43 <br />
