• <br />• <br />• <br />(c) <br />his findings of the facts thereon shall be final and <br />conclusive. <br />For delays caused by acts of God, or of the public enemy, <br />fire, floods, epidemics, quarantine restrictions, strikes <br />or walkouts, and freight embargoes, the Contractor may <br />be granted an extension in working days provided that <br />the Contractor notify the Engineer in writing of such <br />delays within ten (10) consecutive working days with the <br />following facts: <br />1. A statement, beginning from the date of award of the <br />contract to the present in a chronological listing, <br />that the above circumstances have caused certain <br />material; equipment and labor shortages which will <br />delay the completion of the project. <br />2. Submit evidence substantiating the delay of all the <br />material or equipment affected by the circumstances <br />covered by this subsection in form of order requests, <br />bill of lading, packing slip, delivery tag, etc. <br />3. A statement either that the above circumstances have <br />been cleared and normal working conditions restored <br />as of a certain day or that the above circumstances <br />will continue to prevent completion of the project. <br />The Engineer shall evaluate all time extension requests and <br />shall ascertain the facts and extent of the time involved and <br />his findings of the facts thereon shall be final and conclusive. <br />No allowance will be made for a delay or suspension of the work <br />due to the fault of the Contractor. <br />(d) The count of elapsed working days, to be charged against contract <br />time, shall begin from the date of "Notice to Proceed" and shall <br />continue consecutively to and include the date of completion <br />of the work as determined by the Engineer, except that working <br />days elapsing during periods of suspension of the work by the <br />Engineer shall be computed as follows: <br />14hen the performance of the work is totally suspended <br />for one or more working days by order of the Engineer <br />in accordance with Subsection 8.9(a) and 8.9(c), the <br />number of days from the effective date of the Engineer's <br />order to suspend operations to the effective date of <br />the Engineer's order to resume operations shall not be <br />counted as working days. Days elapsing during any <br />period of suspension in accordance with Subsection 8.9(b) <br />shall be counted as working days.
