And, then if you look at the joint commission rules, it refers to the Commission has the power to <br />initiate rule-making proceedings. Thus, the Planning Director, in many aspects, is representing <br />the Commission in different levels. Therefore, he makes these recommendations because the <br />Planning Department, as the head of the Planning Department, he is the one, most of the time, <br />having to administer these rules as people come in for these permits. <br />Therefore, I think the Planning Commission still, of course, has the ultimate authority. So, if you <br />guys want to motion now to take these rules under advisement, and to look at these amendments <br />here today, then we can move forward. But, if you guys feel like it was, if you feel like it was <br />improperly initiated, then we'll have to look at that rule again and then re-initiate the <br />proceedings. But, again, it falls under your authority to initiate the proceedings. As we are <br />within the proceeding now, you can choose to continue. <br />HENKEL: Thank you, Corp. Counsel. Is there any discussion on that from this side? From the <br />Windward? Commissioner Ikeda? <br />IKEDA: I do, I'd like to revisit that section because as a planning commissioner, I have a hard <br />time giving up my authority, and so, I would like to get a little more clarification. <br />HALL: Clarification on what? Sorry. <br />IKEDA: Our authority and so forth like you had just mentioned that we have the final authority <br />and the—it seems kind of, from what I gathered reading the rule changes and so forth, I've, I <br />have, I'm getting a mixed message like. And, so I kind of agree with the public what they're <br />saying about the Commissioners giving up the authority. <br />HALL: Okay, do you mean just the authority initiating the proceeding or the authority that's <br />addressed actually in the rule amendment. <br />IKEDA: In the amendment. <br />HALL: Okay. Yeah, I mean, the presentation will address that, but I guess as just a brief <br />overview of it, the amendment I believe you're speaking of is actually just the clarification of <br />powers the Planning Director already has, and they run into these questions and such from other <br />people—I don't, I'm sorry—that question his authority. So, this is just kind of re -explaining it, <br />but it actually is if you read the rule, all, like the assessment and that kind of stuff is all within <br />the rule already. I think the only addition is the interpret portion. But, the Planning Director <br />must have the power to interpret in order to give you guys a recommendation, and then you guys <br />still have the ultimate authority at the end of the day. And, that's also why it comes back to you <br />at the end. Like, that's why I think that we went to initiate the appeal process—that would <br />actually come to you guys as well so that you guys would see that.
