C omm unication No. 2018 - 15 <br /> <br />Policy LU - 3.8: Rezoning Outside of Urban and Rural TODs and Outside of GP <br />LUPAG Urban Area . Rezoning of areas currently zoned agricultural, outside of the <br />Urban and Rural TOD areas shown on Figure 4 - 7 Official Kona Land Use Map, and <br />outside of urba n designations on the General Plan LUPAG, shall not be allowed, except <br />in the following limited circumstances: (1) the rezoning allows only a small number of <br />additional lots, consistent in scale with the transfer of lots to family members, (2) the <br />rezonin g does not create a net increase in the potential number of agricultural lots (such <br />as a rezoning that increases potential density in one area but also reduces density in <br />another), or (3) the rezoning is to permit a subdivision consistent with the Clustere d <br />Rural Subdivision Guidelines, while preserving the majority of the property in non - <br />residential use dedicated to agriculture, open space, or other conservation purposes, <br />and does not have the primary effect of allowing subdivision into lots smaller than <br />a llowed by existing zoning. This policy is intended to prevent the rezoning of <br />agricultural property to allow agricultural subdivisions where the primary objective of the <br />lot owner will be to have a residential estate. <br />Objective LU - 4: Pro - active Design Re view . To foster a spirit of excellence, creativity <br />and collaboration among the applicants, community, and County to meet the Kona CDP <br />goals, objectives and policies. <br />Policy LU - 4.1: Design Center Establishment . The County Planning Department <br />shall establ ish a Design Center to accomplish the following objectives: <br />1. To support and expedite the translation and implementation of the Kona CDP <br />goals, objectives, policies, actions, and design guidelines as applied to proposed <br />development projects; <br />2. To be a catalyst for creative excellence and innovation; <br />3. To foster public - private partnerships; <br />4. To promote coordination and collaboration among the community, government <br />agencies, applicants, landowners, professionals, and educational institutions; <br />5. To provide education on best design practices to applicants, government staff, <br />community members, educators and students; and, <br />6. To award and recognize exemplary projects. <br />Although the Design Center will be administered by the Planning Department and <br />staffed by County employees, t he department may organize a technical committee of <br />interdisciplinary volunteers. <br />Policy LU - 4.2: Mandatory Review . The Design Center shall review and approve <br />provide recommendations to the applicant prior to submittal of the application to the <br />Planning D epartment for all master plans prepared for floating zones (TODs/TNDs, <br />Affordable Housing, Eco - Industrial) and Clustered Rural Subdivision PUDs.
