actually agenda and move forward...because a letter you know is <br /> not really our...the way that the process works...does that make <br /> sense Mr. Guzman... <br /> Mr. Guzman: It does...yes...I'd like to point out a couple things though in <br /> her...the testimony that she gave that there were a number of <br /> errors on what she said... <br /> Ms. Kahakalau: Okay. <br /> Mr. Guzman: Which is unfortunate again but that's seems to be her MO...she <br /> said that her property is not subject to bill 108...and it absolutely <br /> is...she would be required to register it so...that's the truth...she <br /> said that the grandfathering in or having a license to run a transient <br /> vacation rental would transfer with the sale of the property...that is <br /> not true outside of the zones that they're permitted in in this <br /> legislation...so mine...living in an ag zone would not transfer if I <br /> sold that and again that is how it creates an unfair advantage to her <br /> because eventually in other places these would go away so people <br /> would either have to stay in hotels or in vacation rentals like hers <br /> in permitted zones...so when she made that statement...that was <br /> incorrect and she knows it because she's the one introducing the <br /> bill...there is also nothing currently in the bill to guarantee that a <br /> single unit will be grandfathered in...it is incredibly <br /> vague...doesn't say what documentation is going to be <br /> needed...doesn't have...saying anything about an appeals <br /> process...doesn't say anything about how exactly these will be <br /> determined whether or not any of them would be grandfathered <br /> in...so based on legislation that is currently written...there really is <br /> nothing to guarantee that even the single unit will be grandfathered <br /> in... <br /> Ms. Kahakalau: So...I mean those... <br /> Mr. Guzman: One more final thing...she also said basically that hosted <br /> rentals...would not be regulated if somebody lives on the <br /> property...that wouldn't be regulated...well that's not true <br /> either...if someone lives on their property they're allowed to rent <br /> out one room or an Ohana on their property...there are many <br /> people that live on the property but they have multiple units and <br /> they're renting out multiple rooms...that would not be allowed by <br /> bill 108 and she stated the opposite that those people are not going <br /> 19 <br />
