to be regulated and that's simply not true...in fact even those that <br /> have a single room would be regulated because they would be <br /> required to register also...so those are at least three incorrect <br /> statements that she just presented to all of you...my concern to is <br /> that there/she seemed to be getting a green light in all future <br /> counselors are getting a green light that they can simply fail to <br /> disclose income at any time as long at some point they come back <br /> and say well I just forgot...I misunderstood even though I've run a <br /> business for thirty-five years...I don't know what income means <br /> versus profit even though as the Vice-Chair of the Finance <br /> Committee...I don't know what income is versus profit and I <br /> simply misunderstood...so if that's okay...then that's okay and the <br /> board's on record as saying yeah in the future go ahead and hide <br /> whatever you want as long as you come out and disclose it once <br /> you're caught. <br /> Ms. Kahakalau: Alright...I appreciate your comments...I just wanted to let you <br /> know that...if there are...the merits of the bill is not our Kuleana <br /> right now...that's not our responsibility.... <br /> Mr. Guzman: Of course not.... <br /> Ms. Kahakalau: And I can see that you have issues with the bill...and there is a <br /> process you know for you and others to comment as the rules to <br /> the legislature... <br /> Mr. Guzman: I have a comment....inaudible.... <br /> Ms. Kahakalau: Using that process...as far as the...your other concerns about the <br /> financials...if that is a concern...then you need to put that into a <br /> petition and then we can hear that separately...but this was not <br /> the...issue of Petition No. 2018-03 which we just heard...so we <br /> have not made any determination in regards to that because there <br /> has been no petition brought to us so if that's something that you <br /> feel that is concerning to you...then you know that's one <br /> thing...but I'd like to ask Counsel just in terms of the statements <br /> that were just made...to clarify... <br /> Mr. Yoshimoto: Okay to be clear...the board has the ability to also initiate an <br /> investigation...so the board can do that as well...so based on the <br /> information provided by Mr. Guzman...the board could also <br /> initiate a petition or it could allow Mr. Guzman to do that as <br /> well...so there's two options right I mean...just to be clear... <br /> 20 <br />
