<br />Mr. Brilhante: That’s correct and we use it…the County uses this type of contract <br /> employment quite often and then you gave a great example of <br /> former Senator…Andy Levin you know who is the…State <br /> legislature liaison and you know the Mayor has you know <br /> identified him to come in on a you know temporary basis to you <br /> know represent the County in front of the State legislators and you <br /> know again for the benefit of the County of Hawai‘i…you know <br /> when you look at these types of contracts…generally the contracts <br /> is for a limited term you know limited term in nature…here less <br /> than…no greater than twelve months…the other type of contracts <br /> we often see is the 89-day contract and the value with those <br /> contract is because it’s for 89-days…we don’t have to pay the <br /> benefits and you know all other you know issues that were <br /> afforded you know in this contract…but we knew this contract <br /> that…we knew that this project…the computer software migration <br /> was going to take longer than 89-days so to be clear and to be <br /> transparent…we didn’t want to engage in like three or four 89-day <br /> contracts you know going forward…to me that would’ve been <br /> more of a questionable practice…here…the HRS 76-77-16 <br /> specifically affords the County the option to enter into an <br /> employment contract as long as that contract is for no greater than <br /> one year and no greater than $750,000 and you know we met those <br /> requirements and we do it quite often…. <br /> <br />Mr. Robinson: What section was that again…? <br /> <br />Mr. Brilhante: 76-77-16…. <br /> <br />Mr. Goodenow: HRS… <br /> <br />Mr. Brilhante: HRS… <br /> <br />Mr. Goodenow: Well we appreciate…I appreciate that…I don’t know if there’s <br /> further questions if not we can…I can go into…we’ll take a <br /> motion… <br /> <br />Mr. Robinson: I can see where the confusion is because when we look in the <br /> County code…and we see the contracts on 2-85…and it says <br /> County agency may enter into a contract involving services, <br /> property, procure or dispose etc….the contract is awarded by <br /> competitive bidding and the contract is…pursuant to State public <br /> procurement code…so you’re saying then this contract state <br /> procurement code which was 76-77-16… <br /> <br />Mr. Brilhante: That references to a different type of contract…that’s a purchase <br /> contract…here we have an employment contract… <br />15 <br /> <br /> <br />
