The corporation counsel shall, however, be prohibited from representing any elected officer in <br />impeachment proceedings. <br />(1979, Prop. 12; 1979, Prop. 13; 1990, Prop. 14, sec. 1; 2000, Prop. 2, sec. 1.) <br />Section 6 -5.4. Assistant Corporation Counsel. <br />The assistant corporation counsel shall be appointed by the corporation counsel and may <br />be removed by the corporation counsel. The assistant corporation counsel shall be an attorney <br />licensed to practice and in good standing before the Supreme Court of the State of Hawaii. <br />(2000, Prop. 2, sec. 1.) <br />Section 6 -5.5. Special Counsel. <br />The council may, by two - thirds vote of its entire membership, authorize the employment <br />of special counsel for any special matter presenting a real necessity for such employment. Any <br />such authorization shall specify the compensation, if any, to be paid for said services. <br />(2000, Prop. 2, sec. 1.) <br />Section 6 -5.6. Term of Office. <br />Notwithstanding Section 13 -8, the term of office of the corporation counsel, assistant <br />corporation counsel and deputies shall be co- terminous with that of the mayor; provided that <br />where a successor has not been appointed and confirmed, the corporation counsel shall continue <br />in office pending such appointment and confirmation, but in no event shall the corporation <br />counsel continue in office beyond three months, whether acting or otherwise. <br />(1979, Prop. 13; 1990, Prop. 14, sec. 1; 2000, Prop. 2, sec. 1.) <br />CHAPTER 6 <br />DEPARTMENT OF FINANCE <br />Section 6 -6.1. Organization. <br />There shall be a department of finance consisting of the director of finance and the <br />necessary staff. <br />(2000, Prop. 2, sec. 1.) <br />Section 6 -6.2. Appointment and Removal. <br />The director of finance shall be appointed by the mayor, confirmed by the council and <br />may be removed by the mayor. The finance director shall have had a minimum of five years of <br />training and experience in budgeting or related fields, at least three years of which shall have <br />been in a responsible supervisory capacity. A deputy finance director shall have had a minimum <br />of three years of training and experience in a responsible financial position. <br />(1979, Prop. 12; 2000, Prop. 2, sec. 1; 2000, Prop. 7, sec. 1.) <br />Section 6 -6.3. Powers, Duties and Functions. <br />The director of finance shall be the finance officer of the county and shall: <br />(a) Assist the mayor in the preparation and execution of the operating budget, <br />operating program and capital budget. <br />(b) Collect special assessments as provided by and subject to law. <br />16 <br />
