minutes 03-08-00Page 23 of 35 <br />HIGASHI: Second. <br />RAY: All in favor? <br />COMMISSIONERS: Aye. <br />RAY: Chris, in the final preparation of the whole document of changes, would you try to make it not so complicated so <br />people don’t get too confused? I mean, we’re moving this to here but make it like a simple thing. <br />YUEN: Yes. There are going to be two parts to this when we finally do it, and I will work with you folks in making the ballot <br />question. That’s what people are going to vote on, and we will try to do those as simply as possible. The other part will be <br />what it gets changed to if it passes, and you have to do that. And again, it will be like what you have here with some changes <br />perhaps. We’ll fine tune it but we’ll, in the end, take a vote on exactly what the language will be changed to. <br />IRVINE: But, Chris, you think at this time, this motion we just made, it could be thrown in with number 15, here, so we <br />wouldn’t necessarily have another Charter Amendment to put out to people? <br />YUEN: Right. We could stick it all in without having another one. <br />RAY: Anything else on 6 and 10? <br />YUEN: Let me comment on just one thing. On this ‘Adopt rules and regulations having force and effect of law’, the Planning <br />Director wants us just to say ‘pursuant to zoning ordinance’ and not the subdivision ordinance because the Planning <br />Commission has not, in the past, passed rules and regulations on the subdivision ordinance. I don’t think we need to get into <br />that anymore right now, but I thought I’d just mention that. <br />RAY: So you anticipate that we’d take that out? <br />YUEN: Quite possibly we would, but let’s leave it for now and I just wanted to mention that. We might come back to it later. <br />HIGASHI: It is critical if they don’t pass rules and regulations and we have it in, though. That would force them to <br />promulgate rules and regulations for subdivisions. <br />YUEN: No, the Planning Commission doesn’t have a role in subdivisions, so that’s why. The Planning Commission does not <br />have. The Planning Director passes the subdivision, not the Commission. <br />HIGASHI: So, therefore it should not be in at all. <br />YUEN: Yes, I think that is correct, that it should be out. <br />MARTIN: Out of the Planning Commission? <br />YUEN: Yes, the subdivision rules and regs. <br />MARTIN: Who made the suggestion to take that out? <br />YUEN: Planning Director. <br />RAY: Number 7. Legislative Research Office. <br />HERKES: Has Connie seen this yet? <br />RAY: Yes. They’re disappointed.
