So if you have a nine - <br />person commission, and there's only five people there, one person won't go along with the other <br />four, they can't get a majority for anything, and according to Matsukawa, they can't even <br />continue the matter until they can get more members in, which is kind of absurd. <br />Thirteen-four(g) -. <br />RAY: Wait a second. <br />YOSHIYAMA: Yeah. <br />RAY: Gary. <br />YOSHIYAMA: Yeah, I have a question. Don't we have some provision or provisions now <br />in law that says that if a board or commission does not act within a certain period of time, you <br />know, it's like an approval? <br />WURDEMAN: There was a State law passed -, last legislature was it? <br />YOSHIYAMA: Yeah. Board of Water and Natural Resources or something? <br />WURDEMAN: Yeah. <br />YOSHIYAMA: So in that case, if there is no action, no quorum, then there is approval? I <br />don't know if we have it in the Charter though, you know. <br />WURDEMAN: No, we don't. <br />YOSHIYAMA: Okay. <br />WURDEMAN: And in some of the Planning Department's -, I forget what it's for. <br />RAY: I think Mr. Yuen has something to add. <br />YUEN: No, no, he can finish and then I'll jump in. <br />WURDEMAN: There's one -, do you recall what it is, where if they don't act within so <br />many days, it's disapproved? Was that SMP? <br />YUEN: Well, that's been -, that was changed in the -, T think in '96. There are <br />some, there are some zoning permits, some Planning Commission type permits that -, Planning <br />Department permits, if they are not approved in so many days, they are disapproved, and there are <br />some that if they're not approved in so many days they're automatically approved. <br />20 <br />
