COMM. 243: <br />From Commissioner Scott Unger requesting to include language regarding voluntary <br />contributions to the land fund in Section (b) of Comm. 218; that portion of the sentence <br />was inadvertently omitted in the motion to approve the substitute language. <br />CHR. HAITSUKA: Do I have a motion to include the excluded language from section <br />(b) in Comm. 218? <br />Mr. Nahale -a moved to include the excluded <br />language as noted in Comm. 243. Seconded by <br />Mr. Shumway and carried by the following vote: <br />Ayes: Commissioners Honma, Jarman, <br />Kawauchi, Kealoha, Nahale -a, <br />Osborne, Shumway and Chair Haitsuka. <br />Noes: None. <br />Absent: Commissioners Fuertes, Kaulukukui <br />and Unger. <br />CHR. HAITSUKA: Any further discussion on the original motion? Ms. Kawauchi. <br />MS. KAWAUCHI: Mr. Chair, I have discussion concerning subsection (a) and in <br />particular the underscored language, "Deposits to the fund will occur at a minimum of <br />twice a year, but directly after a majority of the taxes have been collected." I feel that <br />language is unclear and that we should move to clean the language up by adding more <br />specificity as to the time of the actual collections. In our discussion at the February <br />meeting, we had heard from the finance department representative, Ms. Sako, that what <br />the interpretation by the department would be concerning this language is that the <br />collection would be made in March and again in September; and after the tax collection <br />due dates for each fiscal year. So, I would propose that if we were to move this to pass <br />second reading that we should include language that makes the collection schedule more <br />definite and more certain; so there is no ambiguity as to when the deposits will occur into <br />the fund. <br />CHR. HAITSUKA: Any further discussion? Is that the motion? <br />MS. KAWAUCHI: I could make it a motion. May I make a motion at this time? <br />CHR. HAITSUKA: Let me check with Mr. Hookano. Mr. Hookano, the question is <br />whether or not Ms. Kawauchi can make a motion at this point in time to amend CA -15. <br />MR. HOOKANO: Yes, she can make a motion to amend at any time. I would ask that it <br />be kind of specific so we know what the commission is voting on. So, if she has specific <br />language she would like to insert, that would be preferable to a general statement. It <br />should be specific as to the language that you would be inserting. <br />10 <br />
