CHR. HAITSUKA: Yes. <br />MS. KAWAUCHI: I will withdraw my motion and propose a new motion. <br />Ms. Kawauchi moved to amend the last sentence <br />in subsection (a) of CA -15 to read, "Deposits to <br />the fund will occur at a minimum of twice a year, <br />but no later than 30 days after the majority of taxes <br />have been collected." Seconded by Mr. Kealoha. <br />CHR. HAITSUKA: Is there any further discussion? Mr. Shumway. <br />MR. SHUMWAY: Does 30 days provide enough time for the Finance Department? Are <br />you comfortable with that number, Ms. Crawford? <br />MS. CRAWFORD: If the language reads "30 days after the majority of taxes are <br />collected," then that works fine. If you tied it to some earlier date, we would transfer <br />anyways. If you had said 10 days, we would transfer whatever we had, but that wouldn't <br />accomplish what you are trying to accomplish; 30 days is okay. <br />MS. OSBORNE: Would 45 days be better? We just heard hesitancy the last time. It <br />seemed like 30 days might be a challenge. <br />MS. CRAWFORD: 45 days would probably allow for more funds to be in there and <br />reported to make the transfer. We are going to pick up whatever we have at that point; <br />and the earlier you cut if off, the less you have. We don't leave it open; our intention <br />when we said in this language was that "directly after" but 30 days is okay with that too, <br />because the idea is we know when we have the majority posted, and it probably would be <br />within 30 days. <br />CHR. HAITSUKA: Are there any further questions? Thank you Ms. Crawford. Is there <br />any further discussion? I have a comment. The sentence, to me, doesn't make sense <br />because of the way it is set up. The front part of it says, "Deposits to the fund will occur <br />at a minimum of twice a year...." That means, to me, you are going to have a minimum <br />of two and you can deposit more times a year. Then you have "but" in there, and then it <br />says pursuant to the motion, "no later than 30 days after the majority of the taxes have <br />been collected." So it seems like that modifier doesn't work in there, with that "but" in <br />there. I think the intent is there is going to be two main deposits and then the County will <br />have the ability to make additional deposits as they collect taxes throughout the year. <br />But, the way it is written, I don't think is correct to give the effect of that. <br />MS. KAWAUCHI: So, the amendment makes it worse. <br />13 <br />
