MS. CRAWFORD: Yes, I can't think of any reason you would want to stop us from <br />doing that by pinning us down to only allowing once a quarter. <br />MR. SHUMWAY: Mr. Chairman, I think saying minimum was fine. I think the intent is <br />to say there are a minimum number of transfers that need to be made, and we don't need <br />to say anything more than that, in my opinion. <br />MS. OSBORNE: "At a minimum" gives flexibility, just the example she stated, if they <br />need that extra for a land purchase at a certain time. <br />MS. KAWAUCHI: So what I have down is, "Deposits to the fund shall occur at a <br />minimum quarterly; and further transfers to be made at the discretion of the finance <br />department." <br />MS. JARMAN: No, you don't need the last part; because if it is "at a minimum," they <br />have discretion to do it whenever else. So, "Deposits to the fund will occur at a minimum <br />on a quarterly basis." Does that make sense? That is how I would word it. <br />CHR. HAITSUKA: I think that works. <br />MS. KAWAUCHI: Mr. Chair I would like to withdraw my previous motion and make a <br />new motion. <br />Ms. Kawauchi moved to delete the last <br />sentence in subsection (a) of CA -15 and <br />replace it with, "Deposits to the fund shall <br />occur at a minimum, on a quarterly basis." <br />Seconded by Ms. Osborne. <br />CHR. HAITSUKA: Any discussion? <br />MR. HOOKANO: Mr. Chair, I know our Legislative Research Branch is going to say to <br />change the word, "will" to "shall." <br />MS. KAWAUCHI: And that is very appropriate, so I will amend my motion. <br />Ms. Kawauchi moved to amend her <br />previous motion to say, "Deposits to <br />the fund shall occur at a minimum, <br />on a quarterly basis." <br />MS. JARMAN: At a minimum, quarterly. You just want to change "will" to "shall." <br />CHR. HAITSUKA: Ms. Kawauchi. <br />MS.
