MS. JARMAN: You should go to law school. That is the kind of question we ask <br />students on exams. Does preservation, in and of itself, include maintenance? That's an <br />interesting question. Can you preserve it without maintaining it? <br />CHR. HAITSUKA: Ms. Crawford. <br />MS. CRAWFORD: If I could just make one comment. It says, "Monies in this fund <br />shall be used solely to: 1) Purchase or otherwise acquire lands or property entitlements in <br />the County of Hawaii for...." And that is the purpose of those lands, not how the money <br />can be spent, is my read of that. <br />MS. OSBORNE: That is how I read that also. <br />MS. HONMA: So that means the monies cannot be used to preserve, is that correct? <br />MS. CRAWFORD: That is correct. That is why I don't think it is necessary to then have <br />a whole list of things that you cannot spend the money on, because it says, "solely ", with <br />emphasis, to purchase or otherwise acquire lands or property entitlements; period, The <br />rest of it is the reasons, not how to spend the money. <br />MS. HONMA: I guess because it says "including" and that is where I got that idea. <br />There is that word, "including," and that's where I get the impression that it's including <br />those reasons and you can use the money for that. <br />MS. CRAWFORD: Well, it's also for public outdoor recreation and education. <br />CHR. HAITSUKA: Ms. Kawauchi. <br />MS. KAWAUCHI: Mr. Chair, maybe part of the reason why it's being read this way is <br />because of the use of commas and semi - colons which kind of makes it look like it's <br />another clause. <br />CHR. HAITSUKA: Mr. Shumway. <br />MR. SHUMWAY: Mr. Chair, going back to the January meeting, and that was the <br />original language, the uses are the same. It looks like they are just copied directly; in a <br />different format, but the same wording. <br />CHR. HAITSUKA: I think the intent was to purchase lands for preservation, but I don't <br />know if that necessarily carries through with the way it was written; but I think that was <br />the intent in that Section, 1). <br />MS. JARMAN: It might make it clear to say, 1) Purchase or otherwise acquire lands for <br />property entitlements in the County of Hawaii for: i) public outdoor recreation and <br />education, including.......; ii) da da, da da, da da; iii) etc. <br />20 <br />
