MR. NAHALE -A: Mr. Chair, did you suggest that it say at the end of this, "... as <br />determined by the corporation counsel." <br />CHR. HAITSUKA: That is correct. <br />Mr. Nahale -a moved to add language to <br />Section 15- 5(c)(2) to read, "...as determined <br />by the corporation counsel." in order to <br />clarify who makes the determination as to <br />the sufficiency of a petition. Seconded by <br />by Mr. Kealoha and carried by the following <br />vote: <br />Ayes: Commissioners Honma, Jarman, <br />Kealoha, Nahale -a, Osborne, <br />Shumway and Chair Haitsuka. <br />Noes: None. <br />Absent: Commissioners Fuertes, Kaulukukui, <br />Kawauchi and Unger. <br />CHR. HAITSUKA: The next concern involved Section 15 -4(g), and this is a similar <br />problem to the one we just discussed. In Section 15 -4(g) it states that, "If the proposed <br />language is found to be within the power of charter amendment or revision of the County <br />of Hawaii, within five working days of finalization of the petition form, ballot title, <br />ballot question and ballot summary, the clerk shall:..." The problem is it doesn't say here <br />who is going to make that finding. The suggestion is to remove the word "found" and <br />insert, "determined by the corporation counsel." So it would state, "If the proposed <br />language is determined by the corporation counsel to be within the power of charter <br />amendment or revision of the County of Hawai`i..." That would make it consistent with <br />the changes that we just made. <br />Mr. Nahale -a moved to delete the word <br />"found" and insert, "determined by the <br />corporation counsel "in Section 15 -4(g). <br />Seconded by Mr. Shumway and carried <br />by the following vote: <br />Ayes: Commissioners Honma, Jarman, <br />Kealoha, Nahale -a, Osborne, <br />Shumway and Chair Haitsuka. <br />Noes: None. <br />Absent: Commissioners Fuertes, Kaulukukui, <br />Kawauchi and Unger. <br />CHR.
