meeting where it can be legally agendized." The suggestion is to take out the phrase, <br />"amend a petition, or..." So it will say, "If a majority of the committee does not choose <br />to collect additional signatures..." So it would have that language deleted. The same <br />reason would be that amending a petition after it has been signed does not seem to be <br />something that should, or could, be done without notifying the signators. <br />MS. HECHT: We agree; that makes sense. Thank you. <br />MS. WILKINS: Yes, thank you. <br />CHR. HAITSUKA: Do I have a motion to amend Section 15 -3 and 15 -4(1) in accordance <br />with the recommendations of our attorney? <br />Ms. Osborne moved to delete the words, <br />"amend" and "or" from the last sentence in <br />Section 15 -3 and to delete the phrase, "amend <br />a petition or" from Section 15 -4(1). Seconded <br />by Mr. Kealoha and carried by the following <br />vote: <br />Ayes: Commissioners Honma, Jarman, <br />Kealoha, Nahale -a, Osborne, <br />Shumway and Chair Haitsuka. <br />Noes: None. <br />Absent: Commissioners Fuertes, Kaulukukui, <br />Kawauchi and Unger. <br />CHR. HAITSUKA: The next concern involves Section 15 -4(p). And the same - -- <br />MR. HOOKANO: Mr. Chair, I think you mean Section 15 -5(e), as it relates to <br />withdrawing a petitioners signature. <br />CHR. HAITSUKA: That's right, I skipped that one. So, Section 15 -5(e); there is a <br />concern here because it states that, "Individuals may withdraw their signatures by <br />submitting a written request to the clerk within fifteen days after the filing of an <br />amendment or revision petition." The concern is how does the signator know that the <br />petition was filed, because they have a limited time period in which to withdraw their <br />name. <br />So the suggestion is to give notice to the signators by publishing a notice in the paper and <br />tying that in to the time period in which the persons who wish to withdraw their <br />signatures; they must file that request. So the language that we came up with is, "Within <br />fourteen days of the filing of the petition, the committee shall give notice of the filing of <br />the petition by publishing a notice in two newspapers of general circulation in the county <br />of Hawai`i." The existing sentence would say, "Individuals may withdraw their <br />signatures by submitting a written request to the clerk within fifteen days after <br />32 <br />
