HAITSUKA: Maybe we could make it easier by saying something like, <br />"Individuals may withdraw their signatures by submitting a written request to the clerk <br />anytime prior to the certification of the petition." Mr. Hookano, do you see any problems <br />with that? <br />MR. HOOKANO: No. <br />CHR. HAITSUKA: Do I have a motion? <br />Mr. Nahale -a moved to amend Section <br />15 -5(e) to read, "Individuals may withdraw <br />their signatures by submitting a written <br />request to the clerk anytime prior to the <br />certification of the petition." Seconded by <br />Ms. Osborne and carried by the following <br />vote: <br />Ayes: Commissioners Honma, Jarman, <br />Kealoha, Nahale -a, Osborne, <br />Shumway and Chair Haitsuka. <br />Noes: None. <br />Absent: Commissioners Fuertes, Kaulukukui, <br />Kawauchi and Unger. <br />CHR. HAITSUKA: The next concern involves Section 154(p) and Section 15 -9. In <br />particular, Mr. Hookano mentions the requirements under State law as far as publishing <br />prior to the election. In his opinion, depending on when these Sundays may fall; they <br />may be outside of the period required by law. <br />MR. HOOKANO: Well, the Charter amendments will always go on the general election <br />ballot. The State Constitution says that falls on the second Tuesday following the first <br />Monday of November. So, three Sundays prior to that would only give sixteen days, <br />which is not in accordance with the State requirement for publication for Charter <br />amendments. <br />CHR. HAITSUKA: In the existing version of Article XV, it allows for forty -five days. <br />So the suggestion was to amend Section 154(p) and Section 15 -9, the publication <br />provisions, to be consistent with the existing provision of the Charter which then would <br />state something like, "The clerk shall publish the ballot title, ballot question, ballot <br />summary and arguments for and against the measure in..." And everything after that <br />would be deleted; and its place we would add, "...two newspapers of general circulation <br />in the County of Hawaii at least forty -five days prior to submission to the electors of the <br />county." And that same provision would be added to Section 15 -9. So, we would be <br />deleting from both provisions, the phrase, "...in the Sunday paper of two Hawaii Island <br />daily papers with the largest circulation for the three Sundays preceding the election." <br />35 <br />
