IBARRA: Yes , I agree. <br /> BETHEA : Let me ask you specifically , where is this contract <br /> language? And I have the contract 13 (inaudible) . <br /> IBARRA : No, no, it ' s under the financial provision, Section <br /> 10. Okay , it ' s 10-11 , in the second paragraph, that any contract , <br /> lease or other obligation requiring the payment of funds from the <br /> appropriations of a later fiscal , or if more than one fiscal year, <br /> shall be made or approved by resolution. <br /> BETHEA: Which paragraph of of 10-11? <br /> IBARRA: The second paragraph, last sentence. <br /> CUSHNIE: Mr. Ibarra, could the difference have been with <br /> the Boyd Hansen contract that we were not, if I remember <br /> correctly , we were not allocating money but rather we were <br /> granting. . . <br /> IBARRA : The use of. . . <br /> CUSHNIE : . . .the use of the dock, which was a tangible asset <br /> to Mr. Hansen? <br /> IBARRA : In the. . .yes , and one of the legislative <br /> responsibilities is again , authorized use of County property to <br /> enter into a , like a , lease or a contract for the use of County <br /> property. <br /> BETHEA : Why doesn ' t this come up as a budget item? I mean, <br /> you know, the Council sets up the budget. . . <br /> IBARRA : Yeah. <br /> BETHEA : . . .approves the budget. The County. . .if the mayor <br /> want the County to enter into a contract , which is a cost to the <br /> County, why isn ' t it part of the budget that the Council approves? <br /> IBARRA: Okay. There ' s a loophole in there. First of all, <br /> if you were a businessman that. . . selling services to the County, <br /> say, maybe dirt , and you can get it cheap , or you want to buy dirt <br /> for five years. Well the budget only goes to one fiscal year. So <br /> how can you buy in the County without an appropriation? So by <br /> having the Council approve that contract by resolution, you <br /> essentially. . .the Council is committing itself to funding that <br /> contract for a later fiscal year. How the administration gets <br /> around that and. . . I don ' t know if it ' s. . .well , I haven ' t <br /> recommended that they do this , not when I was corp. council <br /> anyway. Yet they go year to year. You know , it ' s like , okay , <br /> five years , we ' ll just go for this year, or sign a year contract , <br /> and then get another one another year, another one another year. <br /> 50 <br />
