In the budget session. . .in <br /> the budget hearing , there ' s again a line item that says <br /> contractual services. And so you would have money appropriated to <br /> enter into contracts. <br /> BETHEA : Now is that specific though? Is it described in <br /> the budget? <br /> IBARRA : Contract services. . .contractual services is the <br /> line item. <br /> BETHEA : Yeah, but I mean, it doesn ' t say what contract? <br /> IBARRA : No. But the fact that it requires money from <br /> another fiscal year. . .a good example is utilities , telephones. <br /> You enter into this equipment contract with Hawaiian Tel for these <br /> new-fangled telephones for five years? You would need the Council <br /> approval to commit to Council to appropriating the money for the <br /> later fiscal year. You may have it for one year. But then you <br /> have no authority to bind the County financially for more than one <br /> fiscal year, because again in the Charter it says before any <br /> contract will be signed under 13-13, the Finance Director has to <br /> certify that there are appropriate funds to cover the contract. <br /> And without an appropriation from the Council , the Finance <br /> Director would not be able to certify that this five-year contract <br /> has funds appropriated . He can appropriate up to the present <br /> fiscal year but not beyond, as far as certification. <br /> JUVIK : Excuse me , can I return just for one minute the. . . <br /> what we were discussing earlier about the right the (inaudible) <br /> right of the Council itself to retain consultants or , in the <br /> conflict with the mayor. . .potential conflict with the Mayor over <br /> this. You see , for example , in Honolulu with the garbage-to- <br /> energy conversion and with the mass transit where the Council <br /> may. . . I mean, it ' s such a complicated. . .technical issues are <br /> involved that maybe Council feels they want a second opinion on an <br /> administrative initiative , whether it ' s a. . .the kind of sewage <br /> treatment plant or the kind of garbage energy plant, but they ' re <br /> not necessarily willing to buy the administration ' s rationale or <br /> costs or whatever. Yet they ' re constrained because they can ' t go <br /> out and get. . .marshal the technical expertise that the <br /> administration has at its call. And, so I guess what I 'm saying <br /> is , right now the mayor has that. . .the mayor can stop them from. . . <br /> IBARRA : Can? Yes. <br /> 51 <br />
