CUSHNIE: Thank you for bearing with me. <br /> VIERRA: Sure. <br /> CUSHNIE: Do you feel then that the commission needs <br /> to be refined in terms of the process necessary for <br /> complaints , even if they don' t require investigation? <br /> VIERRA: I think so. As it stands now, when a. . . <br /> when a citizen complains to the commission, the complaint <br /> is turned over to the department to investigate. That <br /> could work , and then again it could be covered up depending <br /> on the. . . the administrator involved. There ' s no real check <br /> and balance in that system. You have to rely entirely on. . . <br /> GREENWELL: (Inaudible) proof of (inaudible) good. . . <br /> proof of that would be a very good idea. <br /> VIERRA: I agree. I think the citizen should be <br /> represented by. a civilian board within limits , of course. <br /> BETHEA: If I could just summarize for the record <br /> what it looks like to me that confuse. . . that the confusion <br /> arises from is that Section 7-2.4 givesthe commission <br /> certain specific duties, the appointment and removal of the <br /> chief , and the confirmation of the chief ' s appointment of <br /> the deputy and the removal of the deputy. And you know <br /> that the commission has that specific authority . Further- <br /> more, and this is something else that needs to be cleared <br /> up , in 7;2 . 5 , it says , outlining the duties of the chief, <br /> it says shall have such other powers , duties and functions <br /> as may be required by the Police Commission, which in <br /> (inaudible) then had information that there is some other <br /> power in the Police Commission, other than that which has been <br /> listed. <br /> And then it goes on to say in 7-2.3 , except for <br /> purposes of inquiry, neither the commission nor its members <br /> shall interfere , etcetera. So it opens it up and <br /> suggests that there are powers of inquiry. And then it <br /> says it will adopt such rules as it may consider necessary <br /> to its conduct or its business . I think we need to keep <br /> in mind, at least in my opinion, when we get down to <br /> particulars , that that is very confusing. It doesn ' t tell <br /> the commission what it can do and what it can' t do and we <br /> need to work on it. <br /> Let me ask you one specific question. With respect <br /> to the discharge or termination of a chief of police, <br /> should there be a for-cause requirement for some sort. . . <br /> should there be a Charter . . .a. . .something more than a <br /> majority vote that is necessary? <br /> VIERRA: Yes , I think the. . . the responsibility of the <br /> chief. . .the decisions he has to make, often alienate a lot <br /> 201 <br />
