What <br /> I 'd like to see is our Charter aligned with the charters of <br /> the other three counties and, if I may just briefly quote <br /> from the Honolulu charter : Section 7 , the chief of police <br /> shall be appointed by the police commission. He may be <br /> removed by the police commission only after being given a <br /> written statement of the charges against him and a hearing <br /> before the commission. They still can remove him, but I <br /> think for the purposes of the citizens , and for him and the <br /> department, that if there is some wrongdoing, that he <br /> should be like anybody else (inaudible) the written <br /> Charter , at least have a hearing. It ' s obvious there are <br /> no stipulations for that, that the whim. . .you know, and we <br /> look at it, political appointee. <br /> I can envision situations arising where, and this <br /> has happened before, you have the chief investigating a <br /> commissionerbecause of deeds of criminal wrongdoing and <br /> that commissioner wields his power to hire and fire him, <br /> that chief is either gonna go ahead and put his put his job <br /> on the line or he ' s going to back off and allow the <br /> criminal misconduct to continue. And that places him and <br /> the department in a very precarious situation. The <br /> department should be completely removed from any politics . <br /> And they should be able to proceed and investigate anybody <br /> that has been charged for or alleged to have been involved <br /> in criminal misconduct . <br /> The way our Charter is written now itputs the <br /> chief in the. . . the situation where he may have to butter up <br /> to keep his job and I don' t think that 's the position he <br /> should be in. <br /> BETHEA: Well, obviously a. .written charges and a <br /> hearing doesn' t solve that. And since the people go <br /> through it, you ' ve got. . .somebOdy's got 4 votes and ,they're against <br /> you, I would assume that you have,aright to have (inaudible) through <br /> whatever hearing procedures . It suggests to me that if this <br /> is a valid point, that either you would want to have <br /> something more than a simple majority suffice to discharge. <br /> Or you could have some sort of a for-cause criteria. <br /> Perhaps with some further review. Something to give the <br /> chief a little more security and at the same time to <br /> discharge something. . . someone for misconduct or failure <br /> to fill the. duties .
