We also had that catch-all <br /> statement , the commission shall have such other powers <br /> and duties as may be provided by law or rules and regu- <br /> lations. So it could go either way. In our proposal , we <br /> have fashioned this section after, I believe it was Maui <br /> county. They have a similar state. . . set of statements. <br /> So it ' s certainly up to the Charter Commission as to what <br /> your pleasure would be in this area. <br /> BETHEA: Let me go on; I have another question. <br /> LUKE: Yes . <br /> BETHEA: With respect to. . .because I think we under- <br /> stand what you' re talking about. You spelled it out here <br /> and we can decide how we want to do it . Or do you feel that <br /> a personnel director should be removed by the commission <br /> only after a hearing duly held? <br /> LUKE: Frankly, I haven' t thought of this , but I ' d <br /> be comfortable with this language if the commission can <br /> appoint the personnel director , and they have the <br /> authority to do so, if there' s lost confidence in the <br /> director , they should be able to do this. I would <br /> suppose that their loss of confidence would be based on <br /> some fact, because you have a five-member commission and <br /> to get the majority of commissioners to rule one way <br /> would certainly have to be based on some problems of <br /> that . . . like you say, I haven' t thought of it , but I 'm <br /> comfortable with the way it is. <br /> GREENWELL: Mr. Chairman. Is this set up by statute? <br /> LUKE: The appointment and the removal? <br /> GREENWELL: Yeah. <br /> LUKE: I don' t know. <br /> GREENWELL: I was just wondering if isn' t crucial <br /> here, why mention it again. <br /> LUKE: Yeah.
