That ' s <br /> something I 'd like to look into. <br /> BETHEA: In other words , it ' s not clear there are <br /> certain direct appeals to the Circuit Court and there' s <br /> some. . . <br /> YUEN: There ' s some issues out there, let ' s put it <br /> that way. <br /> BETHEA: Duane. This is kind of a broad observa- <br /> tion. And again we' re, you know, attempting to pass on <br /> input and it 'd be helpful too in our deliberations ; and <br /> this is in the spirit of passing on some concerns that <br /> the Planning Commission in particular has asked us to <br /> convey to you in terms of how terms are served out , and <br /> in the area of quorum requirements and voting <br /> procedures. <br /> The commission has from time-to-time expressed some <br /> concern over the interepretation in the Charter of, you <br /> know, in these areas. But as you know, the boards and <br /> commissions being appointed laybodies , you know, their <br /> perception of how their philosophy is articulated , you <br /> know, changes from board to board and board to board with <br /> the various makeups. So that ' s why we. . .you know are not <br /> recommending any specific changes to look into. You <br /> know, we ' re just saying that there ' s been some issues <br /> raised in light of those areas. <br /> BETHEA: You mean. . .are all of those concerns <br /> specifically raised here, for example, with respect to <br /> the ability to reappoint a commissioner who would serve a <br /> partial term? Let ' s say somebody is appointed to fill a <br /> vacancy and George (inaudible) was in that category, and <br /> he serves two years; and there' s an issue then, could he <br /> be appointed to serve a succeeding five-year term? <br /> KANUHA: That ' s one of the issues . <br /> BETHEA: Have you listed all of the issues that are <br /> . . .have been raised in connection with this section? <br /> KANUHA: To my knowledge, yes . <br /> 388 <br />
