BETHEA: So, the quorum requirements and voting <br /> procedures , can you enlighten us what your ' re concerned <br /> about the quorum requirements? <br /> KANUHA: Okay. This actually boils down to Section <br /> 13-4 , item (i) . <br /> (Tape change. ) <br /> BETHEA: I 'm asking a question, but I don' t know <br /> whether you know how to answer it. Maybe the prosecuting <br /> attorney would try. <br /> KANUHA: I don' t know what the answer is . All I <br /> know is during my time in the planning office, we've <br /> tried to pursue this, and it ' s always you know run into a <br /> dead end. Apparently there was something constrictive <br /> connected with the Charter. <br /> YUEN: Some of the state statutes do specifically <br /> authorize agencies to levy civil penalties including some <br /> County functions. But there are civil statutes that have <br /> been established that say the counties have the right to <br /> do planning. Liquor is. . .there ' s a state statute that <br /> relates to that. Public Works , there ' s a state statute <br /> . . . some of these do have a specific power. I ' ll have to <br /> look it up in the state to see which functions . . . the <br /> County functions are authorized to levy (inaudible) . I <br /> think that it requires though authorization through state <br /> statute. I don' t . . . I haven' t studied this particular <br /> issue. I don' t know that this section here was at the <br /> (inaudible) power of the County to levy civil fines <br /> (inaudible) give it the power to have criminal violations <br /> in addition to whatever powers to. . . like civil fines <br /> (inaudible) were given by state law. <br /> GREENWELL: The County creates . . . levies the fines <br /> for speeding, parking or what have you. Wouldn' t that be <br /> the same thing? <br /> YUEN: Well those are. . .the County has the power to <br /> do that because state statutes give that power. . . <br /> GREENWELL: So the County gets the power to <br /> (inaudible) to? <br /> YUEN: Yes , so you have to go look at . . . I have never <br /> done this yet , but you have to go look at. . .the zoning <br /> powers of the County which are spelled out in Chapter 46, <br /> Hawaii Revised Statutes , and see whether they. . .whether <br /> the County' s zoning powers rule the power of levy of <br /> civil penalty towards (inaudible) violation. <br /> 389 <br />
