Discussion: Bethea: See Sec. 13-4 (i) and Sec. <br /> 4-4 of Charter. Some commissions are only advisory. <br /> L'Orange: Solution is not changing majority <br /> definition, but making sure commission has its full <br /> powers . He ' s complaining about someone whose term has <br /> run out and commission is without its full compliment <br /> of members; i . e. cannot have majority vote. Bethea: <br /> Needs clarification of 13-4 (i) : Does "entire member- <br /> ship" include unfilled positions? Second issue: on <br /> advisory commission, majority of those present vote to <br /> make action valid. Advisory commission only goes to <br /> Council for final determination. Greenwell: Unfilled <br /> seat represents area of island; vacant seat represents <br /> non-representation of an island area (Tape 1 : 1 : 23) . <br /> Bethea: Questioned whether should be difference <br /> in vote requirements if board/commission is only (1) <br /> issuing advisory opinion or (2) making final <br /> decision. Omonaka: No. Chairman plays a big role in <br /> direction board/commission takes. Boards/commissions <br /> that have power to enact rules and regulations that <br /> affect citizens , Charter says should have majority of <br /> membership. Bethea: Re advisory boards/commissions , <br /> majority of those present at meeting is sufficient , <br /> because higher body will make final decision. <br /> Suggests that when commission has vacancies , does <br /> "majority" mean, of the positions filled? Greenwell : <br /> Charter should state "majority of nine members" so <br /> that if vacancies exist , pressure is put on mayor to <br /> fill the vacancies. <br /> Yuen: Board/commission language with authority <br /> needs clarification. Proper language would be: "the <br /> vote requires the majority of members to which the <br /> commission/board is entitled. " Re advisory boards/ <br /> commissions , Charter Commissions needs to make a <br /> policy decision. Planning Commission is not an <br /> advisory commission. Juvik: Would leave distinctions <br /> between advisory-capacity and decision-making boards/ <br /> commissions as is . <br /> Cushnie: Wished to discuss the subject of non- <br /> attendance of board/commission members and removal of <br /> non-attending members . <br /> 732 <br />
