Although the act purports to <br />require uniform county manager gov- <br />ernment, such would seem to be of no <br />force in light of the broad constitu- <br />tional exception to uniformity with re- <br />gard to defining the powers of county <br />commissioners. Thus, county manager <br />government by local legislation should <br />be upheld by the courts. <br />At this time, no counties with a <br />manager are known to operate; under <br />the statute. The reasons for this arc <br />unclear. it could be that because the <br />statute rigidly prescribes the manager's <br />powers and duties. administrative flex- <br />ibility is hindered or prevented. it <br />could also he that county commission- <br />ers are more accustomed 10 resorting to <br />local legislation than to general law <br />for authority. <br />Tn 1974, the General Assembly <br />passed another general law which au- <br />thorized a manager in counties of 400.- <br />ti00 population or less.
