"county manager and vest in <br />office powers, duties and resp - <br />hilifics of an administrative t <br />The qualification, method of selec- <br />tion, appointment, compensation. <br />tenure and such other related plat- <br />ters pertaining to the office of county <br />manager shall be provided for. by the <br />board of commissioners of any coun- <br />ty of the state. <br />The act may raise more questions <br />than it answers. One thing it docs seem <br />to do, though, is authorize creation of <br />the office by ordinance or resolution of <br />the hoard. As to questions raised, one <br />concerns the effect, if any, it has on <br />the 1922 statute. Although the 197.4 <br />law does not , purport to repeal the <br />earlier statute, there are several incon- <br />sistencies. The 1974 law appears to be <br />a far broader grant of authority to the <br />board of commissioners to fashion the <br />duties and powers of the manager. Un- <br />like the 1922 statute which defines the <br />responsibilities of the manager, the <br />1974 act authorizes the board or the <br />General Assembly, without voter ap- <br />proval, to create the office of manager <br />and vest it with powers and duties of <br />an administrative nature. A major <br />question with this seemingly broad <br />grant of power, however, is what the <br />words "administrative nature" mean, <br />for they might be interpreted to mean <br />anything from clerk -like ministerial <br />tasks to highly discrction;lry_ duties. <br />Reconciling the two statutes, as well as <br />determining how much authority may <br />be given the manager under the 1974 <br />law would be the job of the courts. and <br />they might limit the permissible scope <br />of the duties of "an administrative na- <br />ture" to those found in the 1922 statute. <br />By Local 1_egislot<ion <br />Creating the office of county man- <br />ager/administrator by local act is a <br />'common alternative. This -approach <br />provides fora chief administrative otli- <br />Cer Whose powers and duties are tai- <br />lored tothe needs of the county. The <br />exact form the office assumes depends <br />on the local act, and often only remote- <br />ly approaches the county manager en- <br />visioned by the 1922 general statute. <br />For example.
