In this case, the board, by <br />passing ordinances amending a local <br />legislative act, considerably diminished <br />the power of the chairman and in- <br />creased that of the hoard regarding em- <br />ployment and discharge of non -merit <br />system employees subject to board con- <br />trol. The chairman argued that the <br />board lacked the authority to amend <br />this local act of the General Asscnibly <br />and that such action drastically altered <br />the county's form of government. The <br />court ruled that this action affecting <br />personnel subject to the jurisdiction of <br />the county commissioners was per- <br />mitted under hone rule and that the <br />ordinances did not change the form of <br />government. <br />From this, the conclusion could he <br />made that because a county manager <br />is not an elected official and is subject <br />to the jurisdiction of the county gov- <br />erning authority, action establishing the <br />office and defining its powers by home <br />rule ordinance would appear to be <br />constitutionally permissible, and would <br />not bring about a change in the "form" <br />of government. <br />County manager government via <br />home rule avoids securing passage of <br />local legislation or ratifying a local <br />amendment. It also avoids the rigid <br />county manager form of government <br />prescribed in the 1922 law. The very <br />ease and flexibility in creating the of- <br />fice, though. may be the bigtest liabil- <br />ity in the eyes of a professional county <br />manager/administrator.
