'rwo of <br />those excluded matters not to be acted <br />on by the board arc action affecting <br />any elective county office or its salaries <br />or personnel, except personnel subject <br />to the jurisdiction of the county com- <br />missioners; and action • affecting the <br />Composition, form, procedure for elec- <br />tion or appointment, compensation. <br />and expenses of county commissioners. <br />Finally, home rule authorizes county <br />commissioners to fix salary, compenL <br />cation and expenses of those employed <br />by it and. to establish and maintain <br />retirement or pension systems. insur- <br />ance, workmen's compensation and <br />hospitalization benefits for these em- <br />ployees. <br />While home rule appears generally <br />to authorize boards of county commis- <br />sioners to establish the office of man- <br />ager/administrator, some provisions <br />raise doubts about this power. Lan- <br />guage seeming to support such action <br />is that authorizing the enactment of <br />ordinances or resolutions relating to <br />property, affairs and local government, <br />the 'provision permitting the amend- <br />ment of much local county legislation <br />applicable to the board, and the last <br />clause in the first exclusion concerning <br />personnel subject to board jurisdiction. <br />Language raising doubts can be <br />found in the two exclusions. In the first, <br />it is not clear whether the creation of <br />such an office would he action "affect- <br />ing" any elective county office or its <br />salaries or personnel. The issue raised <br />by the second exclusion is whether such <br />an office would change the "form" of <br />the hoard of county commissioners. In <br />addition. the power lodged in the coun- <br />ty commissioners to fix salaries and <br />expenses of its employees might be <br />seen as a limitation. <br />There are few court opinions on this <br />matter, and most offer 'little help.
