MR. SILVA: Well, basically, it' s not good to have <br /> two bosses., In fact, I feel like I got three bosses, and as long <br /> as they all go in the same direction, I' ll have no problem, but if <br /> they start going in different directions, then it' s going to be <br /> very difficult. <br /> The three bosses, I define, No. 1, that' s the State Legislature; <br /> No. 2, the Civil Service Commission; No. 3, the Mayor. And as I <br /> say, as long as they all go in the same direction, there' s no <br /> problem. But if they go in different directions, then I'm going <br /> to go right down. <br /> MR. SCHUTTE: You mentioned the state. Is that <br /> merely because of the statutes you have to abide by, but not by <br /> day-to-day work. <br /> MR. SILVA: That' s right. I have to follow the <br /> statutes. If you look at the Supereme Court decision, it states <br /> that we fall under the jurisdiction of the statutes, so we have <br /> to do what the statutes tells us to do. If the mayor comes in or <br /> anybody, for that matter, even the Civil Service Commission, they <br /> ask me to do something that' s contrary to the statutes, I would <br /> have to say "no" , and I have done this on occasion. And I might <br /> say that some people get quite disturbed when you tell them "no" . <br /> But what you have to do it. It' s either that or go to jail. <br /> MRS. KOBAYASHI: Mr. Silva, going back to this <br /> training thing, you said that you would like for it to say that <br /> each department head be responsible for training his employees, <br /> not the personnel services department? <br /> MR. SILVA: Well, this is one of the items. What <br /> I'm trying to do is to make this responsibility clear because the <br /> statutes, up to July 1, 1978, there was a section in the Hawaii <br /> Revised Statutes, Section 76-38, which gave the personnel directors <br /> authority and responsibility in the training function. That entire <br /> section was taken out. <br /> MRS. KOBAYASHI: And the reason was because they <br /> set up a state-wide training program? No? <br /> MR. SILVA: That could very well be part of the <br /> reason. Then after July 1, 1978, Act 48, Session Laws of Hawaii <br /> 1978, they repealed this section on training which gave the local <br /> director the authority for much responsibility in training and <br /> they set up this new organization which where they put the <br /> responsibility for an overall statewide training program with the <br /> state department of personnel services and they left the directors <br /> of the counties, and some of the other people that I mentioned <br /> earlier, as advisors. <br /> MRS. KOBAYASHI: So that' s why you want the Charter <br /> to say that now, since the state law was changed to repeal this , <br /> you want the departments now. You want--- . <br /> MR.
