MR. TRULSON: I seem to recall a point in one <br /> prior meeting and I want to go back to Section 9.2 on Qualifi- <br /> cations. Maybe this is not the time to bring this up but I <br /> recall that there was something not constitutionally correct <br /> as far as the qualifications are listed in the Charter. <br /> MR. ONO: Is this the residency requirement? <br /> MR. TRULSON: Right. <br /> MR. ONO: I am not sure. There have been <br /> recent cases that have upheld some residency requirements. . . <br /> MR. LEGASPI : May I say, Bud, I think there <br /> is a letter which I am submitting in my proposal to fit this. <br /> I think the qualification here is invalid and that I am sugges- <br /> ting a remedy for it. <br /> MR. KIM: Mr. Chairman , my name is Song Gin Kim. <br /> I am from the Civil Defense Agency. Harry Kim, who is the <br /> Administrator, had to go to Honolulu this afternoon so I am here <br /> representing the agency. This agency was created and organized <br /> under Statute 127 and we operate under that statute. At this <br /> time, I do not wish to request or recommend any change. <br /> MR. SCHUTTE: You are Mr. Kim, is that correct? <br /> Tell me, how does this work in with the county. Where: does this <br /> fit within the County Charter? <br /> MR. KIM: I think in the County Charter on Page <br /> 39 we are listed as "other agencies" . We are not even listed as <br /> . . .we don ' t even have a title there in that paragraph. <br /> MR. SCHUTTE : The reason that I asked is that <br /> I couldn ' t find anything and we were just wondering if we were <br /> in the wrong room. You mentioned that the Office of Civil <br /> Defense stands status quo on the Charter as it stands, or as it <br /> governs the Civil Defense today. Now, what we are interested in <br /> is how and what portion of the Charter would you come under. <br /> You said Page 39. . .what portion of this. . . transitions and <br /> provisions? <br /> MR. KIM: Yes , I think it would come under the <br /> provisions. I can ' t find anything else or anywhere else that we <br /> are listed. <br /> MR. SCHUTTE : There is actually nothing here <br /> that I can see that even lists the Civil 'Defense. Are you saying <br /> that it should be kept out of the County Charter, as such, or are <br /> -- you. . .would you like to say that it should be included within it. <br /> -22- <br />
