MR. SCHUTTE : Section 3-5 , page 3. Vacancy in <br /> office. <br /> MS. ISBELL: If the person has an unexpired <br /> term of less than one year, obviously, he has either resigned or <br /> he has died. <br /> MR. SCHUTTE: All I am saying, Ms; Isbell, is <br /> Just quoting what it says right here in the charter. In Section <br /> 3-5 . Vacancy in Office. Under that it says that "when any <br /> vacancy occurs in the county council , the remaining members of <br /> the council shall appoint as a successor a person of the same <br /> political party as the person he succeeds.','_. .-The only thing <br /> this particular portion does not say--does not spell out or <br /> define "vacancy. " What does "vacancy" mean. . . <br /> MS. ISBELL: That. is _correct. All _ri-ght but <br /> -what -you are also saying is if you are putting someone in for <br /> an expired term you are ousting the person who has been elected. <br /> You can ' t do that unless he has resigned or died. There is no <br /> provision for that. <br /> MR. SCHUTTE: That is exactly what I said. <br /> I say there is a provision here but this says "vacancy" it does <br /> not spell it out as to whether you can do this or make an <br /> appointment to take over somebody' s position until he gets well <br /> again. . . <br /> MS. ISBELL: Right. This is a permanent thing <br /> that you are talking about in 3-5 . If a person were put in, <br /> that ' s it. It' s done. It ' s for the rest of the term, it says. <br /> MR. SCHUTTE: I said "vacancy: " We do not have <br /> a definition of "vacancy:" What does "vacancy" mean? <br /> MS. ISBELL: Somewhere in here it says a person <br /> has to resign or die. <br /> MR. SCHUTTE: I 'm looking right here where it <br /> has the section that handles vacancy. All I 'm saying is that we <br /> do not have a definition of vacancy. And that is the difference <br /> here. If vacancy were defined in this particular section it <br /> might take care of what you are suggesting. <br /> MS. ISBELL: Well, if you were to have a vacancy <br /> defined as a person who is ill, how would you be able to apply <br /> (a) and (b) ? <br /> MR. SCHUTTE : How would I apply ( a) and what? <br /> MS. ISBELL: How would you apply (a) and (b) to <br /> a vacancy of a person who is ill? You are actually replacing <br /> him. <br /> MR. SCHUTTE: I don ' t know. I 'm just quoting <br /> exactly what I have here and I 'm just mentioning that there is <br /> a particular section <br /> - 20 - <br />
