The revised printing is in this white volume which <br /> does not have the subcategories ( a) and (b) . <br /> MS. ISBELL: When did they get taken out? I <br /> mean, how could it be taken out? <br /> MR. ODA: It was revised in April of 1976. <br /> MS. ISBELL: This is a ' 76-County Charters. . <br /> Well , I don ' t know what to say about that except this is what <br /> we have been using to study from and regardless of--I agree with <br /> you, Kalani , that the vacancy is very vague if that is all it <br /> says in yours. What we have been going by is if the .unexpired <br /> term is there and you replace him he is obviously dead or re- <br /> signed. You cannot replace a person just because he is ill-on <br /> a permanent basis. There has to be an interim appointment some- <br /> how stipulated in that charter. I ' ll have to talk to my lawyer <br /> friend and get him a new set of books. I didn ' t know things <br /> were that bad but hard times are all over. <br /> Do you have any more questions? <br /> CHAIRMAN SAKATA: I have one question, <br /> Ms. Isbell . On this county council , are you proposing that the <br /> councilmen shall serve for four years? Have you people ever <br /> looked at a two year term? <br /> MS. ISBELL: Yes, we did. We feel that the <br /> same as Maui and Kauai, the people who are doing that two year <br /> term do not really appreciate or enjoy having to go around <br /> every two years. The people themselves say well maybe it is <br /> good because we can clean our house every two years. But they <br /> don ' t. They rarely do. Those same people go in pretty much. <br /> If you really feel that someone isn ' t doing their job and <br /> sometimes you need two years just to get your feet on the ground <br /> as you know this happened here in this county. You need the next <br /> two years to start functioning. So if you have a two year term <br /> and you don ' t produce as some of our councilmen have not for the <br /> past two years, we would have gotten rid of them and they would <br /> never have had an opportunity to prove that they have learned <br /> something and that they can function which is happening now. <br /> So, I say, a two year term doesn ' t make sense. It doesn ' t give <br /> a person enough time to do a good job. If you give them <br /> staggered four year terms you have the continuity and you still <br /> have the opportunity to take them out by impeachment if they <br /> are not doing a good job. So, just like the senators, you put <br /> them in for four years and if they are not doing a good job <br /> they are voted out the next time around. Your level , the county <br /> level, they can be taken out other ways. <br /> - 22 - <br />
