MR. ISHIDA: Okay? Section 3-4 will be <br /> renumbered Section 3-5 . That remains no change.' <br /> Then Section 3-6. Vacancy in Office. That <br /> remains as is. <br /> Next Section, 3-7. Removal of Councilmen. <br /> The last word in that sentence /law/ is to be deleted and <br /> replaced by this charter. So' it' will read, Any councilman <br /> may be removedby `i'mpeachment proceedings as provided by <br /> this charter. <br /> Next Section© Section 3-8. Organization of <br /> the Council ; Officers ; Employees. There is no change in this <br /> except there will be a new paragraph (c) added to this section. <br /> Subparagraph (c) will be added to this section which is still <br /> yet to be drafted by legal counsel which, in essence, will <br /> provide the authority of county council to hire its own legal <br /> counsel. <br /> MR. SCHUTTE : I would like to point this to <br /> the attention of Stuart. Section '5-2.5 . Special Counsel. <br /> The council may, by two-thirds vote of its entire membership, <br /> authorize the employment of special counsel for any special <br /> matter presenting a real necessity for such employment. . . <br /> It is already in there. <br /> MR. ODA: That is basically to hire special <br /> attorneys to represent the county in litigation. That is <br /> what it has been used for. <br /> MR. SCHUTTE : But was that the intent of it? <br /> I would assume that that would give them the authority that <br /> they needed. <br /> MR. ODA: The intent was for litigation <br /> purposes. Special matters like. . . .that the county attorneys <br /> just wouldn ' t have the expertise and background. . . . <br /> MR. ISHIDA: That provision is in the <br /> corporation counsel ' s provision and consequently the inference <br /> is that the corporation counsel still supervises the special <br /> counsel. <br /> MR. SCHUTTE : What is this supposed to be <br /> then , this new addition? <br /> MR. ISHIDA: It is just giving the council <br /> the authority to get its own counsel for its internal purposes. <br /> MR. ODA: just to advise the council. . . <br /> MR. SCHUTTE: On a permanent basis? <br /> MR. ODA: Yes. It has nothing to do with <br /> litigation or anything like that representing the county. . . <br /> -35- <br />
