MR. OMONAKA: Mr. Chairman. Did you accept that <br /> motion? <br /> CHAIRMAN SAKATA: Mr. Oda said it was okay. <br /> MR. OMONAKA: I thought we already acted on this. <br /> It carried by the majority of the commissioners and I think any <br /> other motion to that subject would be out of order unless there <br /> was a motion to reconsider. <br /> If the subject matter is carried upon by the <br /> majority of the commission, are you saying that the same subject <br /> matter can come up again? <br /> MR. ODA: I 'm just basing it on what we have <br /> already done. <br /> CHAIRMAN SAKATA: The motion is on the 5-2-2. <br /> Mr. Cadinha, you seconded this, didn 't you? <br /> MR. CADINHA: Yes. <br /> CHAIRMAN SAKATA: Any discussion on this? <br /> MR. OMONAKA: Mr. Chairman. I still am not too <br /> clear. What motion are you amending? The motion is already <br /> carried. <br /> MR. TRULSON: That' s a motion to amend the <br /> amendment that has already been carried. Mr. Cadinha could <br /> not do it before because your motion for amendment had not <br /> been voted on. Now it has been and as I understand the rules <br /> of order, you can make a motion to amend the amendment as long <br /> as it is in the same vein. <br /> RECESS: At 4:41 p.m. the Chair called for a short recess. <br /> RECONVENE: At 4:50 p.m. the meeting was reconvened. <br /> CHAIRMAN SAKATA: Mr. Oda, would you give us an <br /> opinion on that? <br /> MR. ODA: Mr. Chairman , I can only refer to <br /> certain portions of Robert ' s Rules with regard to amendments. <br /> I would specifically refer to Rule #56 in regard to motions <br /> to modify or amend and the rules do not seem to--at least, I <br /> haven 't found any specific rule or section applicable to the <br /> question presented. However, there is a--during the recess-- <br /> there is a provision that I came across which depending on <br /> whether Mr. Trulson ' s motion is an attempted amendment of an <br /> amendment--under the rule #56. . "an amendment of an amendment <br /> cannot be made. " Now, if Mr. Omoraka' s motion was an amendment <br /> -9- <br />
