Comm. 41: Statement from Garry Garrison , President, Kona <br /> Coast Chamber of Commerce, outlining the <br /> Chamber' s recommendations for Charter revision. <br /> Motion was made to receive and <br /> file Communications 40 and 41 <br /> by Mr. Trulson. Seconded by <br /> Mr. Yagong and unanimously carried. <br /> RULES OF The Chair requested legal counsel , Attorney <br /> PROCEDURE: Stuart Oda, to detail Section IX of the Rules <br /> of Procedure for the Commission prior to the <br /> start of the public hearing. <br /> ATTORNEY ODA: Rules of Procedure, Section IX, <br /> Subsection A, "All persons desiring to speak before the <br /> Commission shall register with the Secretary prior to the <br /> convening of the meeting and shall provide the Commission with <br /> their name, address , and organization they represent, if <br /> applicable. No person who fails to register shall be heard. " <br /> On that point, the county council requested <br /> last week, Saturday, that we do not apply strict enforcement to <br /> that particular rule. I assured them that the Commission would <br /> be very liberal and that rule would be used only in extreme <br /> circumstances. <br /> Subsection B "The Chairman shall call the <br /> name of the person desiring to speak, and all persons shall <br /> speak before a microphone and be informed that their statements <br /> will be recorded. " <br /> Subsection C, "All statements before the <br /> Commission shall be in reference to provisisons in the Charter <br /> of the County of Hawaii or those that may be proposed as <br /> amendments or additions thereto. Statements not relevant, at <br /> the discretion of the Chairman, shall not be heard or considered. <br /> Whenever requested or appropriate, the speaker shall specify the <br /> charter provision referred to so that members may be familiar <br /> with its provisions. " <br /> That provision is to prevent any discussion <br /> on matters that are not related to Charter amendments. People <br /> might have complaints about county road crews or whatever. <br /> Subsection D, "All statements are to be made <br /> to the Commission in general , and not to any specfic member, <br /> unless in response to a question by the said member. " <br /> Subsection E, "At any time, the Chairman or <br /> any Commission member may interrupt any person making a -state <br /> ment for a clarification or answer. " <br /> On that point, it is self-explanatory but no <br /> Commission member or Chairman need to wait for , the completion <br /> of the entire statement before asking for a c1_arfication or <br /> question. <br /> - 2 - <br />
