FLOODPLAIN MANAGEMENT § 27-6 <br />Section 27-6. Basis. <br />The areas of special flood hazard identified by the Federal Emergency Management <br />Agency in the Flood Insurance Study dated April 2, 2004, along with all subsequent <br />revisions and amendments, and the Flood Insurance Rate Maps, dated April 2, 2004, <br />May 16, 1994, July 16, 1990, and September 16, 1988, and all future changes, revisions, <br />and amendments to these documents, are hereby adopted and declared to be a part of <br />this chapter. The Flood Insurance Study and Flood Insurance Rate Maps, and all future <br />changes, revisions, and amendments to these documents, are on file at the Aupuni <br />Center, Department of Public Works, 101 Pauahi Street, Suite 7, Hilo, Hawaii 96720. <br />(1993, ord 93-78, sec 3; am 1994, ord 94-74, sec 3; am 1995, ord 95-86, sec 3; am 2007, <br />ord 07-169, sec 5.) <br />Section 27-7. Compliance. <br />No structure or land shall hereafter be constructed, located, extended, converted, or <br />altered without full compliance with the terms of this chapter and other applicable <br />regulations. The terms of this chapter shall be enforced by the standards set forth in <br />article 6. <br />(1993, ord 93-78, sec 3.) <br />Section 27-8. Other laws and regulations. <br />All construction and improvements subject to this chapter shall comply with other <br />applicable laws and regulations including, but not limited to, the zoning, building, <br />electricity, plumbing, subdivision, erosion and sedimentation control chapters of the <br />Hawaii County Code, and the storm drainage standards, October 1970 edition, or later <br />revisions, of the County of Hawaii. This chapter, designed to reduce flood losses, shall <br />take precedence over any less restrictive, conflicting laws, ordinances, and regulations. <br />This chapter is not intended to repeal, abrogate, or impair any existing easements, <br />covenants, or deed restrictions. However, where this chapter and another chapter, <br />easement, covenant, or deed restriction conflict or overlap, whichever imposes the more <br />stringent restrictions shall prevail. <br />In the event of a conflict between this chapter and the National Flood Insurance <br />Program and Related Regulations (NFIP), as amended, the more restrictive provision <br />will govern. <br />(1993, ord 93-78, sec 3; am 2007, ord 07-169, sec 6.) <br />27-3 SUPP. 3 (1-2018) <br />
