Charter Commission -1 July 13, 2018 <br />Okay, Permitted Interaction of Members. <br />MR. HOPKINS: Commissioner Hopkins. A little bit of clarification on that. <br />You've specified a moment ago that you're not a board member, but I assume that <br />we can talk to you as the board attorney regarding executive session. <br />MR. YOSHIMOTO: Yes. Okay, I see your distinction. But that's fine. Yeah. <br />Right. <br />MR. HOPKINS: Okay, fine. Thank you. <br />MR. YOSHIMOTO: Okay. Permitted. Interaction of Members. Okay, this is an <br />exception to the Sunshine Law. Basically, it states two or more members but less <br />than a quorum may be assigned to: number one, investigate a matter relating to <br />the official business of their boards; provided that: A. The scope of the <br />investigation and the scope of each member's authority are defined at a meeting <br />of the board; B. All resulting findings and recommendations are presented to the <br />board at a meeting of the board; and C. deliberation and decision-making on the <br />matter investigated, if any, occurs only at a duly noticed meeting of the board held <br />subsequent to the meeting at which the findings and recommendations of the <br />investigation were presented to the board. So basically, what this means is that— <br />CHR. ADAMS: I'm so sorry. <br />MR. YOSHIMOTO: Go ahead. <br />CHR. ADAMS: We don't have a C. So, you're looking at something—we have <br />pernnitted interactions, 2.5 (a) then (b) on the next slide, and then (b) again on— <br />oh, I see, there's the items B and C in there. My apologies. I see it. Got it. <br />MR. YOSHIMOTO: So basically, what this involves is a three-step process. So, <br />if this commission should decide to form what's called ad hoc connnittees, where <br />you have two or more members of the board, but less than a quorum, then you <br />could form committees to investigate tasks on behalf of the commission. It would <br />be a three-step meeting process. So hypothetically, if this is what the commission <br />wanted to do, then first, we would basically have a meeting to set forth the scope <br />of the investigation, then that committee would be authorized to move forward. <br />The committee would go and conduct this investigation. Investigation means <br />talking to the department or whatever scope the commission decides to do. Then, <br />once that committee has its report, that report would be submitted to the entire <br />commission, which is the second meeting, but no discussion is allowed at that <br />point. That's the point, basically, where the public has an opportunity to review <br />those findings, that report. Then, at a third meeting, then you can have the <br />discussion. Jon, did I get that?
